old Ofrman hermit, rescued Friday morn
ing from his dingy room at 2312 Hickory
street, where he was slowly starring to
death. Weygold was sent to the county
Jail for the present. The insanity board
will examine the man and a guardian will
be appointed for him.
Friday morning Weygold told the po
lice he had a lot of money hidden some
where, but would not tell where he placed
his savings. After the police surgeons
had revived the man the police searched
him and found the bills inside his cloth
ing and securely fastened.
With a small fortune on his person
Weygold was literally starving to death
In his room, with his dog as companion.
Fearing the sclrlts of his relatives would
get his wealth the old man hid under his
bench. He said he coiild see the shades
of his grandfather and uncles peering In
at his window, while the ghost of his
bi other sat in a rocking chair In the
room. All, he thought, were conspiring
to get his horde. He went for nearly
three days without food or water, hiding
under the bench, where he was found by
the police. The old man's dog gave the
alarm.
MUNICIPAL BAND FOR OMAHA

Captain Berger of the Royal Hawaiian
band paid a neat compliment Saturday
morning to Omaha's beautiful garden spot
Hanscotn park after visiting that
place. To make the park perfect, in the
captain's eyes, a band should be In at
tendance every afternoon during the out
door season.
The cost of having a band at Hanscora
park every afternoon would be so trilling
per capita and the results so far-reaching
that the matter should be pushed
through," remarked Captain Berger. "The
Hawaiian government has spent In the
last thirty-four years many millions for
maintenance of the royal band, which fur
nishes music to the people every day.
I should think Omaha could well afford
to maintain a municipal band, at least
during the outdoor season."
The captain and his associates feel
pleased with their reception In Omaha.
The band will go to Kansas City from
here, returning home In October.
Captain Berger felt he had a Just critic
ism to offer on the lack of ventilation at
the Auditorium stage. He said the tem
perature on the stage Friday evening was
90. which was very oppressive for the
players. The leader said his bandmen
were used to heat, but when It came to
playing Indoors at a temperature of DO
they were working against a great dif
ficulty. He thought the Auditorium man
agement should improve the stage ventila
tion.

BROKERS ACCUSE RAILROADS
Scalpers Declare Companies Have
Aided Business to Malntala
Combination on Rates.
The ticket brokers filed their showing
preparatory to an answer to nine suits
brought by the railroads in the federal
court asking that an Injunction be Issued
to prevent the brokers from further deal
ing In railroad transportation at reduced
rates. The showing is filed by John J. and
riiillp II. Philbln and Ed Murphy of
Omuha, James B. Martin and T. C. Bennett
of Lincoln. It makes three points why the
Injunction should not be granted:
1. The roads have been guilty of such
laches by permitting brokers for thirty
years to deal In transforation at reduced
rates as to be deprived of any Injunction
relief from damages, If they have sus
tained any damages. Courts of equity do
not hold In favor of sluggish and stale de
mands. 1. Koads have been Dartles to buvlnr and
selling of tickets by brokers and have
aided brokers In handling them.
3. The tickets sought to be protected
are the fruits of an unlawful combination
to fix and maintain passenger rates In the
middle and far western states by the
western tassenger association.

John A. Rlne has been appointed by City
Attorney Burnham to fill the newly cre
ated position of second assistant city at
torney at a salary of J2.0CO a year. D. W.
MVrrow, who was the attorney's first
choice, declined the place. Mr. Rlne won
out In competition with a number of
others. He Is a young man, educated at
the University of Michigan, and has prac
tlced law In Omaha for the last six years.
During this time he has been with the
legal firm of Smyth & Smith. He has
been prominent In local democratic politics
In a quiet way. He filed his oath Batur
day and 'Will take up his new work early
next week.
