murder of Street Car Conductor Flury
at Albright March 8, because of the preju
dice of Jurors against cupltal punishment.
Th examination of jurors was begun in
Judge Sutton's court Monday morning and
continued throughout the dtiy.
County Attorney Elubaueli asked each
Juror whether or not he was opposed to
inflicting the death penally, and so many
answered in tho affirmative that little
headway was made. By adjournment time
in tha evening forty-nine Jurors had been
questiuned and thirty-two excused for
cause, most of them because of objections
to the death penalty. A few were ex
cused because they could not understand
English well and two or three because of
prejudice against the defendant.
The defense has exercised Ave of Its
eighteen peremptory challenges. It Is possi
ble the panel will be exhausted before a
Jury Is secured. In this case a special
venire will have to be called. ,
One of the jurors examined declared he
would not Inflict the death penalty on an
Illiterate person, or one whepe bringing up
or environment had been bad, but he would
have no scruples aguinst hanging an edu
cated man.
The crowd' that gathered to listen to the
opening 'of the case was not as large as' it
was In the O'Hearn case. E. R. Lee and
Hugh Myers appear, as attorneys for th
defendant, and County Attorney SUHangli
Is .being assisted by Deputies Murdock ami
Fitch.
A new Jury reported for duty at 0::10
o'clock and the granting of excuses oc
cupied the attention of Judge Sutton until
11 o'clock, delaying the opening of the
murder case.
Judge Button announced .that bunlneas
reasons would not be accepted as an ex
cuse from Jury duty.
"The most Important business In DougUs
county Is right in this court house." he
declared. "Only statutory reasons will be
taken."
Following the Clark trial County Attor
ney Slabaugh will push the other murder
caees through as rapidly as possible. Ho
will try to dispose, of them before thi
grand Jury assembles May 7. There la a
question whether all prisoners not tried
will have to be indicted bytthe Jury. County
Attorney Slabaugh Is of the opinion they
will not, hut in order to make sure all
pending criminal cases will be placed be
fore the jury for action. This will make a
large amount of work for the grand Jury
and Its sessions will probably continue nt
least a month.

Onialiu won the ln-fct game of the ex
hibition series with Bt. Paul at Vinton
street park Monday afternoon because It
outplayed the visitors from Minnesota. The
latter presented the strongest front of any
team which lias been here this season. The
fans were quite encouraged after yester
day's demonstration. The game was even
all the way through, with Omaha showing
a trifle the better form, enough so to win
by the 4core of 7 to I
Yesterday was the first day the Saints
l.ud presented! a united front this season,
part of the team having been i playing
through Iowa and part at St- Joseph. The
Saints liavo greatly strengthened their team
since laat year by the addition of four
players from the Bt. Louis Browns. Sug
i.rn. Fadtleu. Van Sant and Fiihli. All
these played yesterday except Fr!nk, who
probably will play today, his place being
taken by Slagle, who is thought by some
to be a better tickler. Bo it Is no mean
team which Manager Ix-nnon has sent
against the Colts. Stoval, who was sent
In to heave them over, also is counted one
of their best pitchers.

week, after the most disastrous spring
training trips In the history of the organ
izations. Cold and rain have been encoun
tered on all sides and scarcely a team ot

government ha suggested an adjournment
of the second peace conference at The
Hague, in order not to interfere with the
Berne (Red Cross) conference, where the
Geneva convention will be revised.
Germany has not suggested July, as the
munth for the conference, but is trvins: to
persuade Russia to postpone assembling
The Hague conference, so thut the North
American, Cential American and South
American states may be able tu send rep
resentatives to the European conference
without interfering at the same time with
the Pan-American congress at Rio Jamelro.
