UnusUMl difficulty Is being expeiicnued In securing a jury to try Harrison Clurk. no of the three negroes charged with the murder of Street Car Conductor Flury at Albright March 8, because of the preju dice of Jurors against cupltal punishment. Th examination of jurors was begun in Judge Sutton's court Monday morning and continued throughout the dtiy. County Attorney Elubaueli asked each Juror whether or not he was opposed to inflicting the death penally, and so many answered in tho affirmative that little headway was made. By adjournment time in tha evening forty-nine Jurors had been questiuned and thirty-two excused for cause, most of them because of objections to the death penalty. A few were ex cused because they could not understand English well and two or three because of prejudice against the defendant. The defense has exercised Ave of Its eighteen peremptory challenges. It Is possi ble the panel will be exhausted before a Jury Is secured. In this case a special venire will have to be called. , One of the jurors examined declared he would not Inflict the death penalty on an Illiterate person, or one whepe bringing up or environment had been bad, but he would have no scruples aguinst hanging an edu cated man. The crowd' that gathered to listen to the opening 'of the case was not as large as' it was In the O'Hearn case. E. R. Lee and Hugh Myers appear, as attorneys for th defendant, and County Attorney SUHangli Is .being assisted by Deputies Murdock ami Fitch. A new Jury reported for duty at 0::10 o'clock and the granting of excuses oc cupied the attention of Judge Sutton until 11 o'clock, delaying the opening of the murder case. Judge Button announced .that bunlneas reasons would not be accepted as an ex cuse from Jury duty. "The most Important business In DougUs county Is right in this court house." he declared. "Only statutory reasons will be taken." Following the Clark trial County Attor ney Slabaugh will push the other murder caees through as rapidly as possible. Ho will try to dispose, of them before thi grand Jury assembles May 7. There la a question whether all prisoners not tried will have to be indicted bytthe Jury. County Attorney Slabaugh Is of the opinion they will not, hut in order to make sure all pending criminal cases will be placed be fore the jury for action. This will make a large amount of work for the grand Jury and Its sessions will probably continue nt least a month.
