Federation, says
"We have learned a number of saloons
transacted business and sold liquor hist
Sunday In direct violation of the agreement
made through attorneys that saloons would
be closed Sundays. We have evidence that
saloons In the burnt district were open pub
llcly. that Is, both front and back doors;
that a few of the downtown saloons per
mitted persons to enter by side and back
entrances and supplied them with drinks
and that the same conditions prevailed at
some of the saloons in the residence dis
tricts. "The knowledge of these facts. It Is con
sidered, calls for drastic action on the part
of the federation and this will follow. The
hearing will be for the purpose of Introduc
ing our evidence and completing our case.
It has been agreed with the court that the
pre-emptory writ will be issued the same
day the evidence Is completed. The case
will then go straight to the supreme court.
If the decision of the district court Is up
held there it means we will be in a position
to prosecute each saloon license case In
dividually In the district court.
Xo Effort to Revoke.
"No attempt will be made to have the
license of the 10 saloons revoked at once.
While the application for a writ of man
damus demanded this, yet It will not be
Insisted upon. The closing of these saloons
would Involve 1170,000 belonging to the
school fund, which has been paid In for
licenses, and severe financial Injury to the
men In the liquor business. It is the desire
of the federation simply to be In a position
to secure the revocation of the licenses
through the courts whenever any of these
saloons shows a disposition to violate the
law."
City Attorney Breen saya he cannot well
take up the case until Monday and It Is
possible a criminal trial before Judge Sut
ton may also tend to delay the hearing un
til that date. "
About town there had been no general
Intimation that the lid had been raised
even to the slightest degree.

Tuthlll and others representing the Retail
IJquor Dealers' association of Omaha, vis
ited 221 saloons in the city and left the
following petition for signatures:
, To Whorn It May Concern:
We. the undersigned, voters and tax
payers of Omaha, believing and knowing
from bitter experience that the enforce
ment of ' the Sunday closing feature of
our liquor laws Is working a serious Injury
to the commercial and other Interests of
our city, desire to go bn record as being
heartily In favor ot allowing the former
custom of keeping the rear and side doors
nt our saloons oin to the public on Sun
day to be resumed. We suggest, however,
that the rear and side doors mentioned
lie kept, bolted or otherwise fastened
between the hours of 10 o'clock a, m. and
12 o'clock noon on Sundays.
Members of the committee stated they
expected an average of fifty signers at
each saloon, making In all about l&mM pe
titioners. The purpose is then to present
the petition to such organisations as the
Commercial club, Real Estate exchange
and other bodies of Influence for endorse
ment. The committee expressed itself as
confident that a fjood majority of the
voters' and taxpayers Of the city would
sign the petition for Sunday opening, ex
cent between 10 a. in. and noon
