. Major Miller, representing on appellant
moved that hia client be dismissed, for
th reason that he had been asking for
trial through three terms of court without
auooess. Then It waa found the transcript
had not come until several months attur
Major Miller had thought, ao hia motion to
dismiss was overruled by the court.
Mr. Herdman Iprung a motion to dismiss
th appeal and Mr. Breen read many sec
tions of the statues. Which seemed to apply
to the class of cases under consideration.
H contended that It was appellant's plaoe
to bring up the transcript to perfect the
appeal; while Major Miller held It waa not.
Hla client. Earnest Ressle, had been fined
17 for disorderly conduct.
After some further, cross-firing Mr. Herd
man withdrew Ills motion to dismiss and
the case went to trial.
Th evidence was In and the Jury sent out
at 8:15. Ten minutes later the jury came
In with a verdict of not guilty and Heesie
was discharged. Only $3 of th 17 charged
gainst him In police court was One.
A case against Nettle Boyd for petit lar
ceny was dismissed, the prosecuting witness
having died. The woman gets out of pay
ing a fine amounting to ISO.
Ixm Carter, colored, accused of shop
lifting and fined US In police court, paid til
Into the school fund rather than go to
trial. . Mr. Carter aald he had to leave th
city and could not wait.

ver, where Saturday, night he made an ad
dress at a large banquet at the Brown
Palace hotel, given by the business men's
committee of the Young Men's Christian

rrusade to collect 1200,000 for an association
building there, something that th city
never has had. Mr. Wharton was accont- j
panled .by Secretary B. ; C. Wade of the '
Omaha association and C. S. Ward of Chi
cago, International secretary, who also
made addresses and who will remain In '
Denver thirty days to assist In th money- l
getting campaign. . !
A very dramatic scene was caused at th :
banquet by the announcement that William '
K. Sweet, one of th young men present,
and an Investment broker In business,
would give KS,000 towards the 'fund pro-'
vlded the remainder of th $200,000 ' were
subscribed by February 15. The Denver
Post thus describes It: j
Amid the excited cheering of four score
guests, the announcement was .made last
night at the banquet of' the business men's
committee of the -Young Men's Christian
association, that William R. Bweet, presi
dent of th local organisation, has donated
"&.'0f to the; building of th new horn of
thst body.

of a personal communication to Secretary
W. M. Danner. Immediately upon the read
ing of that paragraph In which the offer
was made, pandemonium broke loose In
the banquet room. As one man the guests
leaped to their feet and cheer after cheer
rang tbrovuch . the. building. Handkerchiefs
were waved In the direction of the generous
donor, who sat motionless In his chair, over,
come with emotion.
The announcement waa made Just after
Mr. Wharton finished telling how Omaha
bad raised tlOO.000 for Its new association '
building. ' Mr. Sweet's total fortune la ea- j
tlmated - aC $150,000. When beginning his
career h waa very poor and wss assisted
to employment and In other ways by the
association. He la now Its president.

Omaha Mlnlwflal association passed reso
lutions commending the Clvlfc Federation,
listened to a r'ea -on behalf of the Young
Women's Christian Association, heard the
report of the committee 6ivthe plans for a
united evancellcal movement next winter
and decided to consider a Bunday school
educational campaign for next month.
Resolutions were passed pledging the
moral and material support of the ministers
to the Civic Federation In Its efforts to
compel the saloons to abide by the provi
sions of the Slocumb law.
Mrs. W. P. Harford, president of the
Young Women's Christian association, made
a plea for support In the coming campaign
for building funds. She said an active can
vass would b carried on from March 15 to
April 16 for money to erect a new building.

quested. George O. Wallace, chairman of the ex
ecutive committee of the Nebraska State
Funday School association, presented a plan
for a union Sunday school educational cam
paign, to begin preferably February I. It
Is proposed to have a series of union meet
ings for a week or ten daye In various
parte of the city, churchee of all denomina
tions taking part, the object being to In
crease the membership of the achoola and
to better present methods of work. A com- i
mittee was appointed to deliberate on the j
proposition. !
The committee on evangellstlo movement '
rejiorted that It had conferred with men la :
Seattle, Portland, Los- Angeles, Denver and
Minneapolis, where united revivals hsd
been held, and found good results had been
obtained In all these cities. The committee
commended the work of Dr. Wilbur Chsp
man, the evangelist, end recommended he
be secured to head a campaign next wln(er.
This report was referred back to the com
mittee with Instructions to make fuller in
vestigation and a more detailed report.
Rev. II. J. Klrchswia read a paper on
"The Social Nature In the Light of Present
Social Conditions."
