Charles J. Greene closed the arguments
In the Burlington tax Injunction matter
Thursday morning In the federal court and
the case has been taken under advisement
by Judge Munger.
The trend of Mr. Greene's argument was
to show the difference between the fran
chise and physical value of the property
of the railroad and its relation to taxa
tion. He maintained that the property of
the railroad In Illinois and Wyoming was
as much a part of the system as that por
tion which lies In Nebraska. He further
held the state board had not accepted the
spirit of the statutes in the matter of thu
assessment of either 1904 or 1906.
The hearing of the Union Pacific aide of
the case on practically the same issues as
prevail In the Burlington case, has been
set for Friday morning. It Is probablo
the Union Pacific case will be submitted
on briefs. Two or three points of difference
of a technical character are Involved In
the Union Pacific contention that may
necessitate a brief argument. But that
matter will be decided upon the call of
the case before Judge Munger Friday
morning.
Governor Mickey listened to the closing
arguments, having come up from Lincoln
the night before.

Judge Francis M. Hamer of Kearney,
the man who never quite and who haa a
record for snatching men from the Jaws
of death even at the last minute, la In
Omaha looking after legal mattera and
meeting old friends.
Judge Hamer has frequently been men
tioned in connection with the office of su
preme court commissioner to be filled when
Judge Letton goes on the bench In Janu
ary. On this subject, however, the Judge
Is not very communicative.
"I have no Inside Information on who
will be the commissioner," said Judge
Hamer, "but I would not be surprised If
It went to Judge Epperson of Clay county,
a brother of former Senator Epperson. .1.
L. McPheeley of Mlndan also has been
mentioned in connection with the place,
but I do not know how much strength he
will have.

Brown of Atlantic, la., looked like a man
ready to run a foot race at an old aettlera'

Brown waa without coat or overcoat, hta

sibility of the man getting In on the prlzo

The man waa arrested Wednesday even
ing on a charge of drunkenness and va
