COURT NOW HAS TAX CASE Jodge Manser Takes I'nder Advise ment llnrllna-ton Protest oa Aaaeaanient. Charles J. Greene closed the arguments In the Burlington tax Injunction matter Thursday morning In the federal court and the case has been taken under advisement by Judge Munger. The trend of Mr. Greene's argument was to show the difference between the fran chise and physical value of the property of the railroad and its relation to taxa tion. He maintained that the property of the railroad In Illinois and Wyoming was as much a part of the system as that por tion which lies In Nebraska. He further held the state board had not accepted the spirit of the statutes in the matter of thu assessment of either 1904 or 1906. The hearing of the Union Pacific aide of the case on practically the same issues as prevail In the Burlington case, has been set for Friday morning. It Is probablo the Union Pacific case will be submitted on briefs. Two or three points of difference of a technical character are Involved In the Union Pacific contention that may necessitate a brief argument. But that matter will be decided upon the call of the case before Judge Munger Friday morning. Governor Mickey listened to the closing arguments, having come up from Lincoln the night before.
