Ball against Mark Sweney,' both of Omaha, In w,hleh Ball charges Bweney with having "knowingly married the wife of another." Both cases present exactly similar features as to character of testimony on which the divorce was granted and as to resulting, en tanglements. The main legal question for consideration by the towa court Is, "Can a person di vorced In Nebraska come across the state line and at once remarry?" If so, he Is dodging the provision of the Nebraska statute, which prohibits the marriage of a divorced person until after the expiration of six hionths from the date of the divorce. Zenelta Ball secured a divorce from Rob ert A. Ball In July last on charges reoog nlsed by the statute, and on testimony given, as Ball alleges, by Mark Sweney. Abfint a month ago Ball filed a petition to have the divorce case reopened, alleging that ho had been deceived by his wife when she brought the case to trial. He says she Informed him she would drop her suit. Ball's suit to reopen the case has not yet been heard. He also has a suit for dam ages pending against Sweney for alienation of his wife's affections. It was after the bringing of the first suit that Mrs. Ball wejjt over to Council Bluffs with Sweney and married him. Other Caae ia Doaalaa. The other case originating In this county Is that of Edmund O. 1 chuchardt, a tailor, against his wife, Emily, for re opening of a divorce case in which she got a decree, and for damages against his nephew. The latter was the principal wit ness for Mrs. Bchuchardt and the next day after the divorce was granted In Omaha by Judge Button the wife and the .nephew went to Council Bluffs and were married. Judge Sutton afterward set aside the de cree of divorce on the ground of collusion between tho plaintiff and her principal wit ness. Bchuchdrdfs main contention, as is the fact. In the Ball case, was that his wife had led him to believe she would not press her suit and had thus allayed his suspicions. This rase and Schuchardt'a damage case against the nephew who married his wife are still to be settled. Mrs. Bchuchardt found herself with two husbands on her hands, one married years ago In Nebraska and one married recently In Iowa. In tho Ball case the divorce suit baa not yet been reopened, and In that phase It differs from the other. And tho Bchuchardt case differs from the Ball case only In tho fact that Bchuchardt did 'not have his nephew arrested. The Iowa justice of the peace who heard the Ball-Bweney case has taken It under advisement to enable, him to look into the law. In this connection It may be stated that the Nebraska supreme court has up held the six months' inhibition against the remarriage of divorced persons. In Ne braska, at least. The exact point raised In the case at Council "Bluffs has, It seems, never been passed on by the higher courts In Iowa.
