That th present crippled financial con
dition of the city may be Illegal and with
out warrant of law is the opinion of City
Engineer Rosewater, who said Thursday
morning that he Intended to make an In
vestigation of the subject for the purpose
ot satisfying himself. His own depart
ment may be forced to suspend much of
Its work or run Into a deficit of several
thousand dollars before th end of th
year, and the engineer la directly Inter
ested In the matter.
To date the new financial arrangement
of the charter enacted by th last legists'
ture have caused the discontinuance of, the
municipal asphalt repair plant with rnlch
necessary work left undone; the announce
ment that the police department will b
cut In two October 16. If about 38.000 Is

decision: crippling the Are department by
preventing the purchase of 10,000 fe of
badly needed hose; shutting off the proper
administration of the city engineer's de
partment; preventing the street commis
sioner from making needed repairs to un
paved streets damaged by heavy rains and
from rroperly cleaning the streets.
Fire Department Saved.
The Are department was saved by the dis
covery that a 1904 bill of 316,000 for ap
paratus had been paid out of 1906 revenues.
The sum was transferred from the general
levy, or sinking fund, back to the Ore
fund, giving the department almost enough
to see It through to December 8L if strict
economy Is practiced.
"There Is a big question In my mind as
to whether or not all this saving and
scrimping and the consequent impairing
of the service rendered by the city govern
ment Is necessary or required by law,"
says the engineer. "It will be remembered
that the annual levy was made and th
funds distributed three months before th
new charter took effect and before It was
prepared or enacted by t,he legislature. The
1906 accounts were figured on the old char
ter basis. The new law requires .that all
delinquent taxes and surpluses remaining
over In funds be transferred to the sink
ing fund, which shall not be used to liqui
dating current revenues. The result Is that
considerable money, which used to be
pTO-rated to th various funds a rapidly
as it came In from back taxes, scavenger
law sales and other sources, could not be
placed la the special or general fund this

financial requirements of the old charter
to carry on the government for the year.
Th result was that not enough money
was levied to take car ' of the fixed
charges and obligations falling due. Bur
pluses from last year which were counted
on were cut out of the 1906 funds altogether.
The natural result was ensuing deficiencies.
"I contend that as & matter of equity
the new charter requirements as to finance
should not have operated until after the
close of 1905. A chance' should have been
given the city government to arrange Its
affairs so as not to violate the law and
still not impair the efficiency of the publlo
institutions. I tan confident that a court "
would bear ma out and if necessary I '
will b willing to carry the case to ad

The bosses of the democrtlo county com
mittee have decided upon ' red Mengedoht,
a building contractor living at 1611 Kyner
avenue as a candidate for county commis
sioner from the Fifth district to run against
W. O. Ure. Mengedoht Is a German, an old
resident, a life-long democrat and well
known, especially among the people of his
own nationality. He Is willing to take the
nomination and do what he can with It. He
never has had much to do with factionalism
in democratic ranks.
Joe Sherry, deputy In th sheriffs offloo,
who thought of trying to get th nomlna-
tlon, has given up the Idea. He Intends to
enter a business when he completes a sis
years' service In his present position.
Among the men recently talked of as pos
sible opponents to Ure Is Millard Fillmore
Funkhouser, who has not taken much ac
tive Interest In politics since his retirement
from the Board of Education.
