The Burlington's request for more track
age concessions from the city Is not ex
actly as reported, there being no apparent
desire to use Ninth street other than to
cross It by the extension of a track up the
alley between Howard and Jackson streets
to Tenth street. The road now has tracks
In the same alley east of Ninth street and
wants to push them a block further. The
purpose, according to the ordlnanoe, Is
"properly and efficiently to serve the ware
houses now existing or that may hereafter
be constructed or ereoted on either side
of the alley."
Conditions are made that the company
shall lay the tracks as directed by the city
engineer, shall pave with any material
designated between the rails and one foot
on both sides, and shall use the privilege
In such a way as to deprive the publlo as
little ss possible from the full enjoyment
of the alley and thoroughfare. The city is
to be protected from damage suits and
liabilities of all kinds.

"Judge, I want to take the pledge right
here and now," said A. S. Francs In police
court Thursday morning when he was ar
raigned before Acting Police Judge Foater
on a charge of petit larceny.
Francs was charged with taking a type
writer from his recent employer, C. W.
Pearsall. The prisoner made no denial of
having the maohlne but wanted to Impress
upon the court that drink caused him to
take that which did not belong to him.
Judge Foster sentenced France ten days
and said that if at the end of that time
the prisoner still wanted to have the
pledge administered he would be accojnmo

Elisabeth Hamm and Ada E. McNear are
suing their husbands, Jacob Hamm and
William E. McNear, for divorce on the
same grounds. The Hamms were married
at Marengo, la., in July. 18M), and the Vic

William Jones, colored, left the police
court room Thursday morning arm In arm
with Lucy Johnson, the woman he refused
to prosecute on a charge of taking two
shots at him Tuesday evening. One of the
shots graced Jones' breast. As Jones would
not prosecute. Miss Johnson was dis
charged. Miss Johnson and Jones have been lovers
for some time, it Is stated. Miss Johnson
entered objections to Jones looking at an
other woman by shooting twice at the
man, just to remind him of his duty to
ward her. Jones bought Miss Johnson a
new bonnet Wednesday afternoon, and It
Is expected the cards will soon be out.
