A letter of Inquiry to Attorney General
Brown with reference to the position taken
by the attorney general's office as to the
law extending the terms of county com
missioners has elicited the following re
sponse, which will be of Interest la teaal
political circles:
This department has officially advised the
several administrative officers of the state
to treat the law touching the election of
commissioners which passed the last legis
lature as H. R. 316, as valid and constitu
tional. Whatever doubts there may be hs
to the validity of this law. they must be
resolved In favor of the law. The courts
recognise the rule that all laws shall be
maintained unless they are so clearly and
palpably unconstitutional as to remove all
doubt In their minds. I conceive It to be
the duty of this department to follow that
rule to even greater length than the courts
sometimes do. I think It Is time enough
for the law department of the state to ile
clnre a law unconstitutional after the
court has spoken. It Is the Judicial prov
ince exclusively to strike down the lawa
of general assembly. . , .
I confess there Is great confusion and
considerable doubt about the validity of
the act In question, but I am still of the
opinion that the act can be construed as
consistent with the constitution and U
has been my advice that It should be so
considered by the several officers of the
state. I do not understand that my dep
uty, Mr. Thompson, has expressed any
different opinion.

court Monday morning F. W. Ellis of
Wllkesorough, Pa., told the court he was
an agnostic and would not go on an oath.
Then will you tell the truth?" asked tha
Judge.
"I will," responded Ellis.
The man was allowed to testify without
taking the customary oath, the first 'In
stance of the kind to occur In police court
for years.
Ellis was arrested with William Larkln.
On Kills' head was a hat said to have been
stolen. He sHl lArkln gave him the hat,
which Larkln would not deny. Larkln
was sentenced thirty days, while Ellis got
a ticket of leave.

Lleutgnant Governor McQUton hag re
ceived a letter from Governor Mickey an
nouncing that he will leave the latter part
of the week for Portland, to be gone for
at least two weeks, and that until after
his return the lieutenant governor will be
expected to look after the affairs of state.
Governor McUUtan said Monday probably
he would make a trip to Lincoln Lae orat
part of next week.
