was the decision rendered at I p. m. Sat
urday by Justice of the Peace Altstadt In
the celebrated Bhields-IIowell dog case.
The hearing of the rase took up a whole
afternoon at the Altstadt court and the
Judge took eight days In which to take the
case under advisement. The decision Is In
favor of the defendant, Charles Howell,
grocery man at Eighteenth and Bt. Mary's
avenue. Hut the end Is not yet, as Martin
Shields (policeman), plaintiff, declares he
will appeal the case and make good his
former statement that he would carry the
case to the highest tribunal In the United
States and spend his last two-bit piece to
keep the dog.
Text of the Declsloa.
Justice Altstadt's decision reads:
In the caso of Martin Shields against
Charles Howell I have considered the evi
dence carefully and think this Is a very
difficult case for a Judge to decide. In the
first piace, there are twelve witnesses
whose credibility cannot be questioned and
who swear positively the dug in contro
versy belongs to the plaintiff; on the other
hand, there are sixteen equally as credible
witnesses who testify Just as positively that
the dng belongs to the defendant. There is
a mistake somewhere, either on one side
or the other. The burde n of proof is on the
plaintiff to show that he is the owner of
the property. In this case there are sixteen
witnesses for defendant, as against twelve
for the plaintiff, and defendant holds re
ceipt for taxes pnld on this dog for the last
three years. I cannot find the plaintiff has
proven ownership by u preponderance of
the evidence. 1 llnd from the evidence that
at the commencement of this action the
right of property and right of possession
taken on the writ of replevin was in the
defendant, and I assess the value of the
aald property at J50 and will enter Judgment
In favor of defendant for a return of the
roperty taken on the writ of replevin
lercln, or in case a return of said property
cannot be had that he recover of and from
aid plaintiff the value thereof assessed, IM,
together with the costs of the suit.
Justice Altstadt admitted that It took al
most the wisdom of Solomon to decide the
case, but "der shudge" Just hied himself
to his villa on South Sixteenth street, rolled
up his shirt sleeves, sat down beside a
pitcher of Ice water and at last reached a
decision with himself.
Martin Shields filed an appeal bond of
1200 Immediately after Judge Alstadt an
nounced his decision and declared his In
tention of carrying the case to the dis
trict court. Meanwhile the-plalntlff re
tains possession of. the dog and the cost
of the suit are accumulating.

Mr. Drummond, who has for the last 20
years been the manager and head of the
Drummond Carriage Co., and has held the
larger part of the stock In the Arm, has
recently secured the Interests of the J. H.
Evans estate In the same company. Judge
Vlnaonhaler has made an order In response
to the petition of Lizzie F. and Richard
R. Evans, disposing of this stock. The
shares were part of the estate of the late
J. H. Evans and the petitioners for the
sale are his executors. The firm now con
sists of Wm. R. Irummond, Omaha; Chas.
McCutcheon of Aurora, 111., and JVm. Astle
ford of Omaha. Mr. Astleford was for
years In the employ of the company, until
I years ago. He Is well and favorably
known to every carriage owner In the city.
He has now purchased an Interest In the
flrrrw and will hereafter have charge of the
building and general repairing department,
which has assumed a large part of the city
trade. Special attention will also be given
to the general repairing of automobiles
In the way of wood and Iron work. In
which this company has already become
familiar with In the last two years.
