The general orders pertaining to the gen
eral courts-martial of Captain George V.
Klrkmun, Twenty-Hfth United Stau-s in
fantry, bavs ben recently promulgated to
the army. It appears that Captain Kirk,
man was given three general courls-mar-lial,
being convicted on two of them and
acquitted on one. Ills conviction brought
wit U it tlrn sentence uf three years in the
United Etates penitentiary at Fort Leaven
worth and his dismissal from the army.
Captain Klrkman was first tried uf Fot'l
Mobiaia under special orders No. i. Janu
ai t. Las; No. 1 Jaauaiy la, ljt, Aud
No. 11, January 17, 1906, Department of the
Missouri, and of which Colonel Jacob A.
Augur. Tenth cavalry, was president, and
First Lieutenant Beverly A. Read, Sixth
cavalry, wai judge advocate. The charges
agalnBt the accused officer were: Charge
1, conduct unbecoming an officer and a
gentleman, in violation of the sixty-first
ankle of war, embodying thirty-one speci
fications; charge 2, conduct to the preju
dice of good order and military discipline,
in violation of the sixty-second article of
war, seven specifications. Being arraigned
under these charges and npeclrlrations
Captain Klrkman pleaded not guilty to
both charges and specifications, lie was,
however, found guilty by the court of all
the specifications in the first charge except
the second, seventeenth and thirtieth, and
of all of the sptciricatlons In the second
charge, also of both charges.
Prealdrat Approves Seatenre.
His sentence under this conviction was
"to be dismissed from the service of the
United States and to be confined at hard
labor for a period of two years at such
penitentlarvas the reviewing officer ahould
direct." 'Pao sentence was approved by
President Rooevelt and the Fort Leaven
worth penitentiary was designated as the
4iln.ci fur hia confinement.
The accused bSicr was again tiled tor a
third time before a general court-martial
at Fort Niobrara, pursuant to special or
ders No. 47. Marcli 13. 106, . Department
of the Missouri, and of which court Colonel
Edward B. Pratt, Thirtieth infantry, was
president and Lieutenant B. A. Read was
Judge advocate. The charges, two In num
ber, were identical with those in his first
trial, there being two specifications in each
charge, all of which he was found guilty.
The sentence In this Instance was dismissal
frcm the service of the United States, and
confinement In the Fort Leavenworth peni
tentiary for one year at hard labor. The
proceedings In this case were also approved
by President Roosevelt. The concluding
paragraph of the order, general orders No.
86. War department, dated June J7, 1905,
states: "Captain Klrkman ceases to be
an officer of the army from June 17, isoij."

Seeos4 Trial at Xloorara.
The second trial of Captain Klrkman
was held at Fort Niobrara, by the same
court, of which Colonel J. A. Augur was
president and Lieutenant B. A. Read Judge
advocate. The charges were Identical with
the two trials resulting in his conviction,
but the specifications were different, these
embodying the fraudulent conversion of
some $tS, more or (ess, of company funds
to his own use. In the alleged purchase
of a phonograph for the company. Com
pany I, Twenty-fifth Infantry, in May, ISM.
Of these charges and specifications the
court found the accused officer not guilty,
and therefore acquitted him. The acquit
tal was disapproved by Brigadier Genera!
T. J. Wlnt. commanding the Department
of the Missouri, In these words:
In the foregoing rase of Captain George
W. Klrkman, Twenty-fifth Inianlry. an ex
amination of the evidence seems to estab
lish beyond a reasonable doubt the charge
of forgery, and beyond all doubt and prac
tically upon admissions !of the accused the
charge of falsifying his accounts and that
of entering and subscribing to a false find
ing as a member of the company council in
auditing said accounts. It is. not under
stood upon what interpretation of the evi

The July building record received two
large boosts Saturday morning, when per
'mlts for the new Merrlam A HolmtUlst
grain elevator at Fifteenth and Manderson
streets, and for the new nve-atory and
basement brick block which Schmoller &
Mueller are to occupy with ' their piano
house at 1311-11 Farnam street, were taken
out. Each is estimated to cost $40,000. -
The grain elevator will be an iron-covered
frame structure 42 feet wide, M feet
long and 133 feet above the tracks. Seeley,
Son Co. of Fremont are the architects
and builders. The piano house Is to be
built. by the J. N. Brown estate and the
eld brick buildings .standing on the site
are to be torn down.' Plana were drawn by

The troubles of Mas Herschman and wife
of Sheely station seem to be without end.
They were arrested Friday evening by
Officer Inda and Special Agent Visard of
the Onion Pacific on the charge of receiv
ing stolen property. Detective Ellsfclder
of South Omaha took the couple to South
Omaha Saturday, to answer the charge of
breaking and entering, the Northwestern
switch shanty- at Forty-fourth and L
streets, South Omaha, several days ago,

When the South Omaha officer read the
warrant to Mr. and Mrs. Herschman at
the Omaha city Jail Saturday morning
the chief misgiving that seemed to bother
Herschman was whether the officer would
pay stret car fare to South Omaha for
himself and wife. , Being assured that the
car fare would be paid, Herschman heaved
a sigh of relief and said he was ready
to start for the Magic city.
A charge of throwing dad rats on the
public streets is now pending against Mrs.
Herschman. The case will be heard in the
loc-al police court next Thursday morning.
