County Attorney Will Not Beat Under
Victonh&ler Decision.

Considerable discussion ha been caused
by the decision uf Judge Vlniionhaler In
(ha rjouKlx" county court holding the
Itate Inheritance tax law of 1901 unconsti
tutional. County Attorney Blabaugh says
that he Is going to take an appeal to the
fllstrlct court Jut ai aoon as he can get
the papers-prepared.
In opposition to the derision of Judge
Vlnsnnhaler the county attorney quotes
Justice Brewer as saying that this Is not
In the nature of a tax exactly, but as a
contribution which the state may levy for
the protection afforded by the laws while
the estate was being accumulated, and
ilso holding it proper because of the laws
provided by the shite for the transmission
Of the legacies In an orderly way.
Judge Vlnsonhaler, talking of the decision
made by him and of Its relation to the
Hrewer decision epokeri of by the county
attorney, says while the laws may be the
same In JUInnla and Nebraska, the state
constitutions tip different. He pointed out
that, aside from the general proposition of
the unconstitutionality of the law on the
(round of nonuniformlty, there Is also 3
provision in the Nebraska state constitu
tion which forbids the passage of any spe
cial law affecting the descent of property.
This he holds to be pertinent because of
the exemptions In the Nebraska Inheritance
tax law.
Hon the Case Arose.
Mentioning the tv4 Carter and the
Urandels estate, which have passed through
the county court here. Judge Vlnsonhaler
ays he allowed the discharge of the ad
ministrators n those cases because It Is
not the province of the county court to
collect the Inheritance tax. In the Wood
case, on which the decision was rendered
he named Samuel Rogers as appraiser of
the real estate on a demand by County
Treasurer Fink for the appointment of an
appraiser. Afterward Mr. Prltchett de
elded they would not pay the tax, and thus
the Issue arose which was the cause of
Judge VInsonliHler's decision.
In this connection it may be mentioned
that there are seventeen counties in Ne
braska In which the Inheritance tax has
been paid. From December 1, 1902, to No
vember 30, 1904, these seventeen counties
collected J6.608.86 under the law of 1901
Nemaha heads the list with $1,182.16. The
other counties In which the tax has been
paid are Adams, Butler, Cass, Clay, Col
fax, Cuming,. Fillmore, Johnson, Lancaster,
MadUon, Otoe, Pawnee, Polk. Washington,
Wayne and York. In Wayne county the
tax collected amounts to only $27.60; In
Pawnee, to $44.75. From these the figures
range, up to J5.s5.88 in Madison. Lancaster
Collected $272.36.
The next large estate to go through the
county court here will be that of the late
Frank Murphy, and Judge Slabaugh hopes
to have the matter settled one way or the
other before the time conies for the final
discharge of the administrator In this case.

Plate Road.

mediate points via Nickel Plate and both
the Lackawanna and West Shore roads.
Train No. 4, leaving Chicago at 2:30 p.
m. dally, has through vestlbuled sleeping
cars for the Buffalo, New York and Inter
mediate points.
Train No. 6, leaving Chicago at 9:16 p.
m. dally, has through vestlbuled sleeping
cars for Fort Wayne, Cleveland, Erie. Buf
falo, New York and Intermediate points,
arriving at New York City early the sec
ond morning.

) When tha last of the old cabbages are
put away it will be like the funeral of Fir
John Moore not a word will be Bald but
the cabbages will speak for themselves.
Their time has come, too, for yeBteiday
who should turn up in the freight yards
but the first caq of new California cab
bages. They are the real union cabbage,
being sent out by the IMacentia Cabbage
Growers' association. They come from
Orange county and are unusually flue, bet
ter than the first Cullforla cabbages have
been In several years. A car of old cab
bages from Wisconsin was also received,
but they were the object of much painful
emotion on the- part of the Jobbers. The
new western cabbages are billed to sell at
214 cents wholesale, against 114 cents for
the veterans. It is probable the price will
Weaken a little next week, for by that time
the western cabbages will be less of t
novelty. - '
Wednesday will be strawberry day again.
I The second car of Texas berries will be
in tnen and will be in a very much riper
and more desirable condition than was the
nrst car. The first berries, which arrived
late in the week, are all gone now and sold
well enough, despite the fact that they
had a little the appearance of having been
grown in a cellar and fed on cocaine.
Omaha, however, has the reputation among
the strawberries and other Imported and
expensive novelties of being rather grouchy
about its eating. The berries point out
that where other cities take them with a
rush, Omaha comes a little slow at the $5
a case proposition. It is said the local
citizen prefers to put his money Into
clothes than hot house exotics.
