university upon Its grounds In Lincoln, ac
cording to plans und specifications on tile
in the office ot the superintendent of con

Bidders must consult tno superintendent
before preparing and tiling bids, upun ail
matters which may appear to them uncer
tain In either plans or forms of contract
and bond on tile with tne bupurintendent.
They must also personally Inspect the uni
versity campus and the building site there
on selected. Bids must conform strictly
to the plans and specihcatlous and to the
requirements of this notice. Bidders must
be prcpured to furnish commercial ratings
or satisfactory references upon their finan
cial standing, If the same b required by
the university authorities. Each bid must
be accompanied by a certified check on
some Lincoln bank, payable to the Uni
versity of Nebruska unconditionally, for
the sum of $000. The check of ti.e success
ful bidder, In case of an award, will be
held as a guaranty for furniBhlng to the
superintendent schedules of materials with
quantities and prices, signing the building

Leroy Messner, the 12-year-old son of
Mr. and Mrs. W. II. Measner, lt14 Seventh
avenue, died shortly after midnight Thurs
day night. That hu death was due to car
bolic acid taken by the boy with suicidal
Intent and not to heart failure, as claimed
by the parents, was the opinion o( the at
tending physicians, and their diagnosis was
confirmed yeaterday by a post-mortem ex
amination. In view of the peculiar circumstance
surrounding the case and the result o( the
post-mortem examination held yesterday
afternoon by Dr. N. J. Rice and M. J. Bel
linger, two of the physicians who attended
the boy, Coroner Treynor decided to ho!d
an inquest. The Inquest will be held this
morning at 10 o'clock In Cutler's undertak
ing rooms.
Young Messner's suicide I a trnglc sequel
to the robbery of a Great Western freight
car Wednesday by a number of boys living
In the vicinity of the Messner home, when
several boxes of cake chocolate were stolen
and distributed by the youngsters among
their companions.
According to the Information obtained by
the police, young Messner was directly Im
plicated In the robbery. It being alleged by
the other boys that he was the one who
broke the seal of the car. Fear of arrest
undoubtedly preyed upon the little fellow
and prompted him to take his own life.
When told of the arrest of the Hlgglns and
Deuel boys by some of his companions, and
that he would be likely arrested, young
Messner Is said to have replied:
"They won't arrest me. I will go away
or do something."

The boy returned to his home Thursday
evening about 6 o'clock, when his mother
noticed him at a hydrant In the yard. He
shortly after commenced to practice cn the
piano, but his mother, noticing his hands
were soiled, told him to go and wash them.
It was while doing this In the kitchen that
he suddenly reeled and .fell to the floor. At
first his parents thought that some of his
companions might have given him Intoxi
cating drink, but aa he rapidly became un
conscious they grew alarmed and sum
moned a physician. All efforts to revive
the boy proved (utile and he remained un
conscious until his death.
The boy's breath smelled of carbolic acid,
as did his handkerchief, but there were no
traces of corrosion on the tongue and
throat. This was explained from the (act
that the acid which the boy Is thought to
have taken was diluted, it having been
used by a member of the family to ally
toothache. The bottle which contained the
carbolic acid and which was on a shelf In
the pantry, was said to be miselng.
The parents of the child were naturally
loathe to believe that the little (ellow hud
taken the acid and thought that his condi
tion was due to heart failure, brought on
by (right at being told he would be arrested.
The child had a weak heart and recently
had been treated (or It. When, however, lt
was evident that the boy had taken carbolic
acid his parents and (rlends of the family
still doubted that he had tuken It with any
Intention to kill himself, but had swallowed
lt believing that lt would make him sick
and that he would thus escape punishment
for his connection with the robbery. Much
sympathy Is felt in the neighborhood (or
the parents and family of the dead boy.

Robert Turner, the negro who shot and
fatully wounded George Chllaon, president
of the Boilermakers' union of Omaha, on
the night of July 14, and was convicted of
mannlaughter, was yesterday sentenced by
Judge Green In the district court to three
years in the penitentiary at Fort Madison.

ney Hess and Hill was released from the
county Jail, where he has been since July

Frank Deuel, 1610 Seventh avenue, the two
boys under arrest, charged with breaking
Into a Great Western freight car and steal
ing a quantity of cliocoiute, were before
Judge Green In the Juvenile division of the
district court yesterday afternoon, but
their hearing wa rontlnued until today,
as ludge Green was given to understand
that other boys were Implicated In the
robbery nnd he preferred to try them all

City Deeds Land Taken In on Fore

The city council at a special meeting
last night agreed to donate nine lots owned
by the city on West Broadway to Messrs.
J. F. Hughes and G. G. Woodln as a site
for their (uctory In consideration of their
removing their wagon box and shovel
board manufacturing plant from Oxkttloosa
to this city. Messrs Hughes and Woodln
had concluded negotiations with the Com
mercial club and all that was needed to
assure the location o( the factory here
was the donation by the city of these lots
(or a site.
In consideration (or receiving these lots
Messrs. Hughes and Woodin agree to
organise a corporation with 128,000 capital
stock, of which 115,000 shall be (ully paid
up at the start, and within ten days after
the execution of the deeds they will com
mence the construction of four frame
buildings, such as they now have In Oska
loosa, each 40xlW (eet, and will continue
to operate the plant (or three years con
tinuously, "subject only to necessary clos
ing required by good business management
and consistent with good faith in opera
tion." In the event o( (allure to operate the
factory as agreed Messrs. Hughes and
Woodln bind themselves to pay the city
12,000 or within 120 days to deliver back
possession of the lots and remove all build
ings (rom same.
The property which the city agrees to
deed to the company to be organized by
Messrs. Hughes and Woodln und which
will be known as the Council Bluffs Manu
facturing company, comprises lots 2, 3, 4,
6, 6, 7, 8, 9 and 10, block 38, Central sub
division. The lots are on the south side
of Broadway between Twenty-fourth and
Twenty-fifth streets and convenient to
trackage. In order to acquire lots 7 and 9
the city had to exchango lots 11 and 12
for them with Gilbert Bros, and Mrs. E. L.
Gretzer, which arrangement has been
agreed upon. The lots ato vnlued at about
1100 each and were acquired by the city
on (oreclosure (or non-payment o( special
improvement taxes several years ago.
The company, lt was stated, will start
operations with twenty-five men, but ex
pects to Increase this force materially be
(ore long. The plant will manufacture
wagon boxes, shovel boards and other
equipments and parts of vehicles.
The Commercial club was represented by
a strong delegation at the meeting Inst
night. President H. H. Van Brunt and
some thirty members were in attendance.
Attorney Emmet Tlnley presented the mat
ter to the council on beliult o( the Com
mercial club.
Foot Ball at Manawa,
The high school teams of Council Bluffs
and Harlan will meet on the Manawa
gridiron this afternoon and the game
promises to be an exciting one. The first
game between the two schools earlier in
the season resulted In the defeat of Council
Bluffs, but the local tenm Intends to re
trieve Itself today. The Bluffs lineup to
day will be heavier than lt was a few
weeks ago. The game will be called at
3 o'clock and the motor company will begin
running special cars to the lake (rom Pearl
street at 1:30 o'clock. This will be the

Simon Charged with Forgery.
Louis Simon, son of the proprietor of
the Central grocery at Broadway and Sixth
street, was arrested yesterday afternoon
under an information filed In Justice
Ouren's court, charging him with forgery.
The arrcBt Is a sequel to the arrest of W.
H. B. Greer and William Bowen, the negro
dining car porters, who were charged by
Simon with the theft of 141 and were ac
quitted. It is alleged that Louis Simon
signed the name of J. Simon to the In
formatlon In the superior court against
