Held Boy for Trial.
Justice Ouren yesterday decided that
Frink Reld, the elevator boy In th Mer
rlam block charged with th theft of a
IIS check from a letter given him to mail
by Mra. Palley, librarian of the publlo
library, did not come within the age limit
of the neV Juvenile law recently enacted by
the Iowa legislature and set hla prelimi
nary hearing for Friday, August E.
When taken Into custody young Reld
stated he was 19 year of age, but hi
father claimed he wa only It, not having
jpet reached hi seventeenth year. Admit
ting th boy- age to be that claimed by
the father, the county attorney contended
that even then th young man did not
come under the law, Which he claimed ap
plied only to youth under 10 year of age.
Th new law In on section says it epplles
on! to children under IS year of age,
whlle ln another It nya I applies to those
who hav aot reached their "seventeenth
birthday." Th county attorney took the
position that when a person. I born I the
first birthday and that the second birthday
come when the child I 1 jear old. conse
quently when Reld wns'l? yenrs of nee he
reached hi seventeenth birthday. On be
half of the lad the contrary was contended
and that he could not be sent to Jail until
his case should be brought to the attention
of a Judge of th district court, who alone
under the new law ha Jurisdiction over
Juvenile offenders. '
Justice Ouren construed the law In th
am way aa the county attorney and de
clded the boy did not com within 11 pro
vision and should be held to answer be
fore him. Toung Reld admit cashing the
check,' but claim he did pot take it-from
the Utter and that h found It near the
mall boa In the building where he was em-
ployed. -
It wa stated yesterday that an appeal)
from Justice Ouren" ruling would teken
to the district court.
