George W. Cooper, an attorney at law,
with an office In the brown block on Six
teenth street, has asked for and been
granted a temporary Injunction whereby
the local officers of the Omaha lodge of
Modern Woodmen of America are estopped
from further assessing him for dues until
the matter of ihe rights of both parties
have been passed upon by the courts.
Mr. Cooper's claim Is that he Joined the
order mentioned In January, 1W1, and that
he has therefore been a member for a
little more than thirteen years. One of the
unequivocal provisions of the constitution
and by-laws of the order. Mr. Cooper says,
at the time he Joined It, was that there
should never be en assessment of more
than B0 cents per member for each 11.0 0
of Insurance carried by such member. For
Instance, provided a man took a policy
for $3,000 at the time he Joined, In the event
of the death of any other member he would
be subject to an assessment of $1.50, pro
vided the society did " have enough
money to pay the amount of Insurance car
ried by the dying member. If It did. there
would be no assessment, and If it only had
partly enough there might be a call for any
fractional part of the $1.60. Hut according
to Mr. Cooper It never was and t.ever could
be more than the fin rents per SI, COO of In
surance carried. His policy of insurance
was Tor $2,000 and whenever his assessments
have lieen made he has, up to recently,
paid Ms $1 and been content.

"But now," to use his own words, "the
order thinks it will bo a Incrotive idea to
freeze some of we old fellows out because
It thinks we may be liable to die pretty
soon, and thus It will be saved paying us
the Insurance that we hnve carried for so
long. But I propose to take issue with the
order on the ground that it cannot make
tho change. Inasmuch ns tho assessment
that may be made was a fixed and definite
part of the constitution of tho order when
It was Inaugurated. The change In the by
laws was made nt the International meeting
of the order held nt Indianapolis last June,
and by It my assessments, that have always
been 50 cents on each $1,000 of my Insurance,
are Increased to 90 cents, rr $1.80 for the
$2,000 policy that I carry. It Is true that
the matter Is not one of such great Im
portance In my individual ense, but It Is
the principle of the thing that I am looking
nt that affects thousands of dissatisfied
members of the order. I put In my claims
In this matter with the proper officials
months ago, but they were Ignored, End
now I propose to havo tho matter adjudi
cated."
Inquiry among several other Omaha mem
bers of the order revealed the fact that all
do not entertain Mr. Cooper's ideas as to
the construction to be put upon the by
laws of the order with regard to the as
sessments that may be made. In fact, his
statement that the constitution provides
that they shall be 60 cents per $1,000 of in
surance and never more nor less Is flatly
contradicted, and It Is said that, from the
very nnture of the order, the assessments
may be made to meet the demands of the
Insurance to be paid. It Is further stated
that even under the Increased assessment
it does not necessarily follow that the
yearly dues of the order will bo Increased,
but that In case It Is necessary to Increase
them, even to the extent of two or three
fold, it would be suicidal to the Interests of
tho members who have paid in their money
for years to refuse to pay the additional,
though there was legal ground for getting
out of it. The date for the final hearing
of the question has not as yet been defi
nitely fixed, but will bo within a few days
and the outcome watched with much Inter
est by members of the order throughout
the country.

Guy Uplngton Fink died here at his home
at 8 o'clock last night of cancer of . the
tongue. Up to four weeks ago he waa em
ployed In the butter department of the
W. R. Bennett Co., of Omaha, where he
was taken sick. He consulted an Omaha
specialist, who pronounced his disease
catarrhal laryngitis and advised htm to go
home, which he did two weeks ago. Since
then he failed rapidly until death came at
8 o'clock last night.

the death of Miss Alice Bartholomew, only
daughter of Oeorge Bartholomew, our city
water works engineer, ar.fr a few days'

in the community.

A. 3. Myers, giving his address as l'J17
Pierce street, was robbed yesterday after
noon of $200 by two men at the point of
a revolver In the Millard hotel The rob
bers ran through the lobby, crowded with
people, got In a hack and dmvs swny be
fore any one could stop them.
Meyers, who was arrested a few dnys
go In a raid made on a gambling house,
says he met the two men In. the hotel and
after agreeing with them to play a game
of poker, hired one of the rooms. During
the game he drew out his roll to pay, and
one of the men threw a gun In his face,
while the other grabbed the hills from
his hand. They both ran and Myers chased
them, but In spite of the number of people
present they managed to get iv, The
police were at once notified but up to a
ate hour last night had not succeeded in
tpprehendlng the robbers.
To the police Myers said tnat he had met
one of the men In Fremont and knew him
by the .lame of Johnny. When arrested a
short time ag., Myers gave the name of
Morris Goldstein and his residence oji 1161
South Fourteenth street. The name signed
on the eglster at the Millard hotel Is A. J.
Clark of Norfolk, Neb.
According to the people at the Millard
hotel It seems that th"re were six men
besides Myers who sat down to the game.
Shortly after they hired the room the men
came down singly nnd the fourth man was
Myers. They say tho first man got Into a
hack and waited for a little time
before the driver appeared and drove
away. No sooner had the hack driven
away, than Myers came down and told the
people that tho man In the hack had 3fl
of his. Ho chased the hack for a couple of
blocks but was unable to cttch It.
The peculiar part of the proceeding la
the difference In the story told by the
clerk at the Millard hotel and the story
told by Myers to the police. The theory at
the hotel Is that while one man ran away
with the money the rest crowdi-d around
Myers and prevented nlm from chafing
until the man bnd safely got away In the
hack. What became of the men who
crowded around Myers Is not known. They
simply disappeared and have not been seen
since. The hotel clerk did not know any
of them and was not nwaro that a poker
game was In progress.
The further the police Investigate the al
leged robbery the more perplexing It be
comes. ' Officer E. R. Smith, who was on
duty at the time, says he saw the robber
run out and Myers after blm. He was right
In the doorway of the hotel when the men
passed him within a few feet, Myers ac
tually brushing tip ngalnst blm. Ho says
that Myers never said a word to him about
the money, nnd he took them to lio half
drunk. He saw the man get Into the, hack
and also witnessed a scufllo between Myers
and the man who Is supposed to have the
money, Myers grabbing the man's hat and
the man grabbing It back. All this time
Myers kept quiet. When Myers was asked
afterward why he did not tell the police
man that he was robbed he said that he
was too excited to think nbout It. The
police believe the hack driver to be David
Cowles. who has a regular rtond cutslde
the Millard hotel.

The secretary of the Interior has ren
dered an Important decision afTectlng the
title to mineral lands within the t'nlon
Pacific land grant. Several years ago a
company of Itramlo men brought suit
for patent to some claims near Cooper
lake, on t'nlon TadAc land, which was
sold to the Bacon estate. The Cheyenne
land office decided In favor of the mining
men, as did also the commissioner of the
general land office, but the railroad com
pany took the matter to the secretary.
Mining men here are Jubilant, for seme
very promising properties have been lo
cated along the Union Pacific.
