WASHINGTON, Feb. .-The seriate to
day passed the diplomatic and consular ap
propriation bill without debate and then
renewed consideration of the Isthmian ques
tion. Mr. Fulton spoke In support of the
course of the administration in connection
with the Panama revolt. Mr. Carmatk and
Mr. Overman In opposition thereto. Mr.
Overton had not prevlouely made hi atti
tude on the treaty known and his peih
revealed the attitude of probably the last
doubtful Biftnler of the senate. The speech
waa Mr. Overman'! maiden effort in the
enate.
Mr. Fulton spoke of Colombia as a coun
try for which It was Impossible to do any
thing because of the character of It peo
ple, of whom he said "diabolism is but the
natural Instinct of a race of bucanneers."
He said Mr. Roosevelt needed no defense
against Mr. Carmack' attacks, and added
that whether the prealdent should be called
to that high office or not his future repu
tation would be a that of the purest, ablest
and most patriotic of presidents. Mr. Ful
ton said that while democrats now praise
President MrKinley It had only been a few
days since he was denounced by them a
a tyrant. He contended that Mr. Roose
velt was the choice of the people for presi
dent and predicted his re-election by a
majority never before knoan.
Mr. Fulton concluded at 2:45 o'clock and
Immediately afterward the senate went Into
executive session and at 4 3o o'clotk adjourned.

The case against Henry Priest of Homer,
who last week waa arrested on. a com
plaint sworn out In County Judge Elmer's
court, signed by Benjamin Friti of Sioux
City, charging him with being a fugltlva
from Justice from the state of Iowa, where
a complaint was lodged against him In
the court of Justice Stafford of Slouz
City, charging him with seduction, waa to
day dismissed for wanl of prosecution and
the costs were paid by the attorney for
the defendant. The interested parties ad
Justed the matter outside of court.

WASHINGTON. Feb. 9 -The house de
voted the entire session today to considera
tion of the resolution reported (run the
elections committee No. 3 unseating M..
Howell dem and declaring Mr. Cntinell
rep., who contested the election, to have
been elected from the Tenth Pennsylvania
district. By agreement a vote will be taken
at 3 o'clock tomorrow.
Mr. Drlscoll, chairman of elections com
mittee No. t, reviewed the history of the
evidence before the committee, and upon
which a report favorable to the contestant
wa reached, also the laws under which
the election was held.
Mr. Johnson S. C), a member of the
committee, contended that the findings
were not Justified by the testimony. Mr.
Birdsall tla.). another member of the h m
m It tee. made a legal argument In favor of
the contestant. Among others who spoke
were Messrs. Wade (la.). Sterling (III ) and
Shull (Pa ).
Mr. Sterling is in favor of the contestant
and the others in opposition. Mr. Thayer
(Mass.) opposed the unseating of Howell,
and when he had concluded the house, at
4:4 p. m., adjourned until tomorrow.

DEATH RECORD.
Miss Belle Flaley.
Miss Belle Flnley died at the home of IW
brother, R. A. Flnley, at 1612 Burdens
etreet. yesterday.
Miss Flnley was bom In Peoria county,
Illinois, and completed her school work at
Monmouth college and afterward attended
a commercial school at Davenport, la. Sha
had lived In Omaha nineteen years, the laat
twelve of which she was a general stenog
rapher In the New Tork Life building. She
waa widely and favorably known in her
business rapacity as well as In her. social
relations. She waa a member of the Cen
tral United Presbyterian church, and aa
long aa her health permitted was an actlvs
member of that church and an earnest
Sunday school worker. She was never mora
happy than when doing something for the
gcod of others.
Four brothers survive her. two of whom
reside In Omaha, one In Goldman. Ark.,
and another at Mt. Ayr, la. The relatives
have the profound sympathy of all who
were endeared to Miss Flnley because of
her true womanliness and Christian vir
tues. The interment will be at the family
home at College Springs, Ia.

MISSOURI VALLEY. Ia.. Feb. . (Spe
cial.) Mrs. J. A. Noble died at her home
at Noble's lake this morning, aged 73
years. The deceased was one of the first
settlers In western Harrison county, hav
ing come here with her husband In IbM,
when the country was new and wild, and
for forty-eight years has lived continuously

Miss Martha Taggart. the daughter of
Mr. and Mrs. J a mo A. Tnggart. died Mon
day at the family home. 1104 North
Twenty-fourth street. Her death was
caused by heart failure. Induced by pneu
monia. Miss Tajrpart was of a very quiet
and retiring disposition, but had acquired
some prominence In local art circles. She
waa a graduate of the Sacred Heart Acad
emy. The funeral will be held this morn
ing from St. John's Csthollc church.

Charles Kerrigan, for the part eighteen
years a resident of Be:rice. died Sunday
afternoon after a prolonged Illness of tuber
culosis, aged " years. He as a member
of Wsshington ramp No. S. Woodmen of
the World, and belonged to the local paint
ers' union. He leaves no family except hi?
wife. The funeral was h-M this afternoon
at 2 o'clock from the' First Irrsbytrrian
church under the auspices of th Wood
men of the World.

Mrs. J. P. Maple, wife of County CI-rk
Maple, was hurried here this morning, the
funeral services having b.-n conducted at
the Catholic church by Father McCarthy.
Mrs. Maple died from the rrtxages of con
sumption, having been confined to her bed
during the last year. She was 35 years of
ag. Her hufband and three children sur
vive her.

Retail hardware dealers in large num
bers sre in Omaha to attend the convention
cf the Nebraska Retail Hardware Dealers'
association, which convened at the Com
mercial club rooms yesterday. The head
quarters of the association are at the Pax
ton and Merchants hotels, and lepresenta
tlves of the various wholesale establish
ments of this And adjacent titles sre
present to get acquainted with the con
vention members and have displays of
their wans at both hotels.
The object of the convention Is lo per
fect a permanent orgnnixation of all the
lia-dware dealers of Nebraska for pro
tective and educational purposes; to confine
trade o lis proper channels and to cor
rect abuses that now exist in business life;
to place the business of the retail dealer
upon such a bals as will enable him to
meet the changed conditions of business
life and lo remove lilt gitimate competition;
to secure the enactment of such laws as
will protect the honest dealer from dis
honest methods of trade combination; to
promote U twe-n merchants a credit system
with each other by correspondence.
Welcomed by Mayor.
Very little business was transacted In the
morning. The afternoon session was called
to order at ;':i0 by President C. A. Peter
son or Oakland, there being nearly
members i:nd visitors presu.1. An Invoca
tiot was rendered by Rev. T. V. Moore and
then followed the address of welcome by
Mayor Mo-ires of Omaha, which was rc
sj.onc4ert to by C. K. Larson o! Hastings.
President Peterson then read his annual ad
dress, whii h was referred to a special com
mittee. The address outlined the work of
the association for the lust year and con
gratulated the members on the growth of
the organisation and the excellent results
of the association Idea. Very few mem
bers have dropped out and the Increase of
membership has largely exceeded the losses.
Appointment of Committers.
The remainder of the afternoon session
was devoted to the appointment of com
mittees and on address on "Hardware In
surance.'' by Secretary H.yJ. Hall of Lin
coln. Today's program. beginning at SSO

their opinions of the Jobbers, the Jobbers
