ern railway to secure ngni-or-way ana
terminal facilities In Omaha assumed a new
aspect yesterday when announcement was
made of an Injunction Issued from Judge
Dickinson's court, restraining the city
council from passing an ordinance now be
fore that body which provides for the va
cation of certain streets, over which the
Mason City & Fort Dodge Railway com
pany has made Its survey.
The case which resulted In the Issuance
of the Injunction was that of Samuel Carr. .
Oliver Ames II and Oliver W. Mink ns
trustees against Frank E. Moores, mayor
of Omaha, and others. The plaintiffs were

srrnunds on which the plaintiffs base their
petition are similar to those embodied In

before Judge Baxter Monday afternoon. It
Is alleged that the Muaon City & Fort
Dodge railway has not complied with cer
tain necessary preliminaries, that it is a
foreign company and has not the right to
acquire property In the state of Nebraska,
and that before the ordinance Is ' passed
which Is now pending before the city coun-

of appraisers to be appointed, must first
hnva been satisfied.
The announcement la made that Judge
Baxter and Dickinson will sit together
upon this case In Judge Baxter's court
Friday morning, at which time all parties
Interested, and all attorneys representing
freeholders, will be heard by the court.
The question as to whether the temporary
Injunction will be made permanent will be

Miss Margaret Harris arrived In Omaha
Tuesday from I,eee Summit, Mo., lit re
sponse to a telephonic message authorized
by her lover, R. Frank Jones, who la lying
seriously 111 at the Bachelors hotel, and
In the evening the pair became man and
wife In the sick chambers of the groom-to-be.
Mr. Jones was formerly a ' resident of
Muylicld, Mo., but came to Omnha, where
he In engaged in business. He was suffer.
Ing from an old attack of appendicitis and
the nuptials wero postponed until he re
covered. A rew days ago. nowever, r,
Jones became very much worse and Mon
day when he requested a friend lo tele
phone to Miss Harris he was suffering
badly. Still lils condition Is not regarded
as necessarily alarming.
On the arrival of Miss Harris It was de
cided not to defer the marriage another
day and 6 o'clock in the afternoon was
fixed as the hour for Cupid's triumph. Rev.
Thomas Anderson, pastor of the Calvary
Baptist church, was Invited to perform
the ceremony. x

the district court Tuesday, when the msn
dumus suit brought by the Nebraska
Tribune and the l'ukiok Znpudu to compel
the county commissioners to award to them
the printing of delinquent tux lists, was
quashed. The commissioners previously
had given the job to Uie VVesUlehe Pregve
and the Osveta and the competing panels
endeavored to have the award set aside,
claiming that neither of the successful
tfheets were qualified according to law. Tit;
court lound no reason to believe this was
true und denied the petition for mandamus
at a hearing toduy.
