Edward Morris, Company D. Twenty-fifth
Infantry, convicted in the United States
circuit court of manslaughter for shooting
Henry McKee of the iama company at
Fort Niobrara, the night of September 17,
1902, was yesterday sentenced to eight
years In Sioux Falls penitentiary and
fined $500. .
His attorney mado a plea tor a new
trial on the ground that tha verdict was
not sustained by the evidence, nor in ac
cordance with the instructions of the court.
Judge McPhorson overruled the motion and
called the prisoner before tha bar and
asked him tf he had anything to say why
sentence should not be passed upon him.
Morris appeared indifferent and remarked
that ha waa not guilty; that the killing of
MoKee waa accidental.
The attorney then appealed for a light
sentence owing to the apparent nonlnten
tlon of -the accused to shoot his companion.
Judge McPherson stated that the prisoner
had been given a fair trial, and neither
the Jury nor the court were prejudiced
against him on account of his color. But
there wera very few mitigating circum
stances connected with the murder, which,
according ti ftjp prisoner's own evidence,
waa sufficient to entitle him, to the full
penalty.
Morris was taken back to the Douglas
county Jail by Deputy Marshal Homan,
with one of the court bailiffs as a guard. The
prisoner was handcuffed, and Just as the
offloer. were ascending the roadway toward
the Jail he made a feint as if to attempt
an escape by Jumping down the embank
ment. Marshal Homan was too quick for
him, however, and he was safely lodged
In JaU and will be taken to Sioux Falls
early next week.

Formaldehyde.
City Prosecutor Thomas Lee expects to
file complaints today against a number
of milk dealers of this city who are using
formaldehyde in their milk. City Milk
Inspector Hutton was conferring with the
city prosecutor Friday' and stated he
had evidence sufficient to convict a half
dosen dealers. This Investigation has been
In progress for some time.
