pop-up to Kemmer. Henderson, the Omaha
alab artist, did great work In this Inning,
striking out Belden, Ron and Hartman,
tha first three Saint up. Omaha scored
another run In its half of tha second.
Henderson went' out on a popup. Carter
Ingled over second and went to third on
an effort to catch him while stealing sec
ond. Carter scored when Frank Bhugart
flew out to center. Welch got a base on
balls, but went out at second on a fielder's
Choice of Wright's Infield grounder.
.Chlnn was substituted for Bowman at
tha opening of the third by the Salnta.
Omaha failed to connect In the third In
ning. Dolan singled, followed by Qenlns
and Mickey, who flew out to Hartman.
Dolan waa caught napping at flrst, retir
ing the aide. For the Saints Chlnn and
Belden struck out. Rohe put a single over
second and Hartman went out on an In
field hit to right. The Omahas went out

liminaries In the Field club handicap tennis
tournament, proved a surprise In some re
spects. After winning from J. W. Battln
by default A. Scrlbner, with- a handicap
half 15. took two sets from J. N. Haskell at
acratch. In two fast played aetr Haskell
won me nanaicap last year and whs
counted on as one ef the sure players In the
finals, while 8crlbher Is a new man with
no particular record behind him, although
he has been playing a very fast game this
spring. The matches throughout were fast
and exciting and the handicapping evened
things up among the playera exceedingly
well.

JACKSON, Ky.. June 17. Argument In
the cases of Curtis Jett and Thomas White
for the murder of J. B. Marcum were not
concluded when court adjourned lata to
night and the case will not be sent to the
Jury until tomorrow noon. It Is Impossible
to describe the anxiety here as to how
long the Jury will continue1 It delibera
tions and a to Its finding. The prepon
derance of opinion still seems to be that
the death penalty will not be given and
that the Jury Is likely to hand between
life Imprisonment and acquittal.
There was more Interest today than ever
since, the trial began, as the people were
attracted much more by the eloquence of
the attorneys than by the evidence. It waa
like a clrcu day. One of the curiosities
for all to see was the dark spot on the
court house floor where the stain of Mar
cum' blood la still visible. The spot In
front of the court house where Marshal
Cockrlll wa shot dead, and the places
where other feudist were killed, wer
pointed out to tb throngs. In the audi
ence In the court room, and a they en
tered and emerged from It. wer pointed
out the mother and other relative of the
prisoner and tha leading feudists.
Twenty Fend Widows Present.
It was staled by residents who are well
acquainted with the people here that at
least a score of widows of feud victims
were present and they represented only a
small part of the bereavement of the
county from such causes.
Early In the day the lawyer got to
scrapping and were only prevented from
coming to blows by officers of the court.
but after Judge Redwlne threatened .to
send one of them to Jail for contempt and
reprimanded another for using unbecoming
language, the proceedings continued with
out any disturbance. The argument of
Thomas Marcum, a brother of the victim.
surrounded by the widow and the orphans
of hi brother and by the widow and or
phana of other victim of the feud, waa
delivered under the most Impressive circumstances.
Two courts were in session here today.
That of City Judge Cardwell succeeded
the arson Inquisitions. On faction ha
controlled tha county and the other town
officer. Owing to assassination and In
timidation the latter had become almost
defunct. Judge Cardwell had not held city
court for eighteen months until martial
law wa recently declared. Like other tn
his depleted faction, he had been a pris
oner in hi own home and unable to get
to hi offioo. Meantime Town Marshal
Cockrlll bad been killed and his place never
filled. The troops now make arrests, and
It waa to hear case arising out of them
that the local court wa resumed. ' The
men who assaulted witnesses yesterday.
after they had appeared before the grand
Jury In tha arson case, were brought be
fore Judge Cardwell by the guard of the
provost marshal and convicted. The fines
and Imprisonment Inflicted are said to be
th first penalties for the violation of law
imposed on feudist here for year.
Ewen Flees to Lexington.
Th principal witness B.-J. Ewen, today
escaped, with most oA .Ma .family, to -Lexington.
As he has. nothing to leave' be
hind him he Is now. considered out of
danger, but there- are mother witnesses for
the prosecution who are not so safe.
Major Embry Allen, who I now In com
mand of the troops during the absence
of Colonel Roger Williams, today advised
Mr. B. J. Ewen to leave Jackson. She has
taken an active part In accumulating evi
dence against tha men who burned her
husband's hotel and who are directly con
nected with th powerful faction In
Breathitt county. Major Allen expressed
th belief that her Ufa was In danger, not
withstanding tha fact that women and
children hav heretofore been spared by
assassin In Jackson. Mrs. Ewen' bravery
and courage have frequently been shown,
and It waa but Unexpected when ah re
plied:
"I will stay her until our Interest are
properly protected and our contracts ful
filled. If they want to kill me they will
find mo hero for at least a month."
A hung Jury Is expected because of tha
alleged attitude of two of th member.

When court convened today Judge B. F.
French, the noted leader of the French
faction of th French-Eversola feud, who la
th leading lawyer for the defenaa of Jett
and White, began tb opening argument
before Judge Redwlne. He declared that
County Judge Blanton, who had said that
Witness Crawford had been arrested, had
lied.
Judge Blanton sprang to hi feet and ap
proached Judge French, but Elisor Jones
threw himself between the men and Judge
Redwlne finally secured quiet In th court
room.
Judge Redwlne then threatened to send
Judge Blanton to Jail for contempt of court
and admonished Judge French to be more
temperate in hi language.
Captain Hurst followed for th prosecu
tion. He declared that hla only motive
for taking part In th prosecution waa to
secure Justice, He said he wanted to see
the law enforced in Breathitt county.
