.Charged with Stealing? Jaak,
A. P. kremenchul. a junk dealer of Grand
Island, has caused the arrest of D. W,
Smith of this city, who makes a living
by collecting Junk, on the charge of steul
Ing 840 pounds of old rubber valued at 5S.
from a car In Omaha. Justice Carson ls-
' sued a search .warrant yesterday morning
" and the rubber alleged by Kremenchul to
belong to hint was found at Smith' place
on Tenth treet and Seventeenth avenue.
Smith returned Tuesday from a ten day'
trip through Pottawattamie and adjoining
cjuntles, 'bringing back with him a big load
of Junk, principally made up of old rub
ber boot and shoes. He was trying to dis
pose of the load to Omaha . dealer when
accused by Kremenchul of the theft. Th
latter followed Smith to Council Bluff
' and claim Smith assaulted him when h
demanded tha return of hi Junk.
Justice Carson will hear the case Fri
day, Smith having given, bond, for hi ap
peal anc.

George Matheson, the young man wanted
for shooting Deputy Sheriff Baker, is re
ported to have been seen Tuesday in the
Ylolnlty of- Macedonia. William Hobson,
Clyde Scott and George Dye. farmers, all
aw a young man malting hi way through
the brush along the Nlshnabotna rrver
whose action clearly indicated that he wa
trying to avoid being een. When hown
a photograph of young Matheson, -they each
were positive that the man they had seen
wa the fugitive.

his way toward Sidney and Deputy Bherlff
Grrneweg, who I In charge of the sheriff's
office during the absence of Captain Cous
ins at th state encampment of the Grand
Array, notified the sheriff at Sidney to be
on the lookout for Matheson.

Postpone Bankers' Meeting.
The annual meeting of Group No. 1 of the
Iowa Stat Bankers' association, which
was to have been held In this city today,
ha been postponed awing to tha speakers
arranged for the meeting having previous
engagements elsewhere. No date haa been
fixed a yet for the meeting, but President
Hart of tha First National bank of this
city stated yesterday that he expected it
would be. held about the middle of June.

The opening session of the Iowa grand
lodge, Sons of Hermann, will be held this
afternoon, although it I expected that but
little business will be transacted beforo
Friday morning. Th grand lodge will be
in session until Saturday.
The biggest delegation Is expected, from
Sioux City, where the headquarters of the
grand lodge are and where three of th
principal officer reside. The Sioux City
delegation will be accompanied by Reed's
Fourth regiment band and will be met at
the depot by the local members of th
order and such delegate a may have ar
rived by then. Headed by the band th
delegate will parade, forming In line at
Willow avenue and Sixth street. Th line ot
march will be: East on -Willow avenue
to Pearr street, south on Pearl street to
Junction ot Main street, thence north on
Main street to Broadway, thence west on
Broadway to First street, countermarch on
Broadway to Sixth street, thence south on
Sixth street to First avenue, thence east
on First avenue to the Royal Arcanum
hall, where the sessions of the grand lodge
will be held.
This evening the visiting delegates will
be the guest of the local member at a
banquet In Royal Arcanum hall, at which
time Mayor Morgan will make hi address
of welcome, which will be responded to by
A. C. Lutse, grand president.
There are twenty lodge of the Son of
Hermann In Iowa, with a membership of
about 6,000. Davenport and Sioux City each
have two lodges, while there Is one In each
of the following towns: Council Bluffs,
Alvord, Plerson, Danbury, Charter Oak,
Manning. Movllle, Rock Rapids, Sibley,
Doon, Schlcswlg, Lester, Midway, Vte, Cor-
rectlonvllte and Remscn.

A Jury In the district court yesterday ac
qultted Mr. Llzsle Thordsen - of the
charge of being implicated ' .with her
husband, John Thordsen, In the theft ot
eighty-five chicken and harness from the
premise of Mrs. Susan Thome In Garnet
township on the night of January last. J
John Thbrdsen, who pleaded guilty to. tha
robbery, was committed to the penitentiary
for two' ytars. r Mr. Thordsen, It wa aV
leged, had accompanied her husband ' In
many raid on chicken roosts disguised In
man' attire. When arrested she admitted
having accompanied her husband and even
tated that the robberies had been com
mitted at her Instigation. When placed on
the stand yesterday she denied being im
plicated and asserted that her alleged con
fession had been made at a time when
she was so 111 that she was not responsible
for what she said. It 1 understood thai
th authorities Intend to hold her oii'othst
case of theft in which she Is allegod to
have been Implicated with her ii'iibanl. In
th case yesterday the Jury brougnt In It
verdict of acquittal within twenty minute
of leaving the box.
Frank 8cagg. Indicted Jointly with
James Brown on a charge of assaulting
Carl Trojan with Intent to commit highway
robbery, was permitted to plead guilty yes
terday to simple assault, and battery and
was sentenced to twenty . days In th
county Jail. He ha been in . t4.lt far sev
eral week awaiting trial and this the court
I took Into account In passing sentence. Sen
tence has not yet been pronounced on
Brown.
May Madaen, Indicted two year ago on
a charge of prostitution, wss fined 150 and
costs, and Mrs. Elisabeth Murphy, charged
with maintaining a house of 111 fame, was
fined $100.
The disposal of these case leave but
that ot John. Fa bey. charged with the theft
of a quantity of overall and other good
from a Northwestern, far, on tha criminal
calendar for this term. Fabey' case ha
been set for Saturday, when It 1 under
stood he will enter a plea of guilty.
At th conclusion of the Litxle Thord
sen trial the petit Jury was dismissed for
the term. j.
Judge Wheeler will this morning mak
an assignment of equity cases.
Lawyer Misses His Train.
Clark Varnum, a prominent attorney of
Chicago, who In personal appearance closely
resembles the 1st Lord Tennyson, poet
laureate of England, missed his train yes
terday morning to Chicago aa the result of
an encounter with a newsboy, and waa put
to tha annoyance of being escorted to the
police station In custody ot a blue-coated
officer. Mr. Varnum had Just left th
Grand hotel and wa hastening to catch a
car when tha newsboy got In his way. Im
portuning him to buy a paper. This an
noyed Mr. Varnum and he pushed the boy
out ot his wsy. Th boy claimed the at
torney slapped htm and complained to
Officer Kirk, who happened to be near.
Th officer compelled Mr. Varnum to accom
pany him to th police station, where he
waa held until he could secure th service
of friends to effect hi release. Judge
Scott later, on hearing th particulars, at
once dismissed th case.
Roger Ha Been In Pen.
Th sheriff's office received yesterday
from Warden Jones of th penitentiary at
Fort Madlaon an excellent photograph of
W. C. Roger, now In th county Jail
waiting trial for th murder of Saloon
Keeper Bert Forney.
Roger, who wa known In th peniten
tiary a No. 1270 at th time th picture
was taken, wa committed from Lucas
county for four year for burglary In 1891,
nd wa discharged In 1894. He wa com
mitted under1 th nam of William Mur
phy. Th description of Murphy which
accompanied th photograph showed that
he had the picture of a woman tstooed In
red and blue on hi right forearm, th
am aa wa recently found on Roger'
right forearm. At th time of hi commit
ment from Lucas county Rogers, or Mur
phy, was 21 year of ago, which would
mak him now $ year old.
Desmond I Now In Jail.
William Deamond, who wss shot by hi
former wife, Mr. Emma Metcalfe, at the
latter a roadhouse Monday night, waa
yesterday placed In the county Jail here to
await a hearing 00 the charge brought
against him by Mr. Metcalfe. Hi wound
I not serious and he Is apparently suffer
ing no 111 effect from It.
Desmond, against whom Mr. Metcalfe
had filed an Information charging him
with robbing her ot $28, was arrested yes
terday morning In Omaha by Constable
Albertl of Justice Ouren'a court. He ac
companied th officer across tha river with
out requisition paper. A second Informa
tion charging Desmond with threatening
to murder her was subsequently filed by
Mrs. Metcalfe. In default of bonds, 'whlcn
were placed at $1,000 In the two cases, Des
mond was committed to the county Jail and
his preliminary hearing set for Friday
morning.

daughter of C. L. Chrlstensen of this
city, started for school yesterday morning
and has not since been seen by her parent
or friends.
The matter has been turned over to the
officers and Justice Pressnall finds that dur
ing the visit of the Hickman & Bessy The
ater company In this city last winter Mis
Chrlstensen wa teen In the company of
Jack Bessy and that she to'.d several of her
echcolmates after the company left that
ehe Would Ilka to go on the stage. She
said that Mr. Bessy had offered her a good
position and that she had a strong notion
to run away and Join him
Testerday afternoon the parents received
a note through the mall, written In a dis
guised man' hand, stating they need not
worry about Hannah or spend any time
looking for her, as she had left with the
writer and his wire and wa going on the
tare.

RAILROAD TRACK WASHED OUT
Rain 'Which Amounts Almost to
Clondbnrst Fall Near
Hasting.
HASTINGS, Ia.. Msy 20. (Special Tele
gram.) The worst rainstorm in years,
amounting to almost a cloudburst, struck
this region this afternoon. A steady tor
rent of water fell for five hours. The
whole country is one continuous sheet of
water and most of the corn and small grain
on the side of hills and bottom la washed
out. A mile of th Sidney branch track
near "White Cloud Is washed out and the
branch trains will be laid up at Hastings
for several days. Much, damage In done to
the new railroad grade.

Frank Baird of Creston, sentenced to the
penitentiary for eighteen years on account
of hi connection with the Sullivan rob
bery at Hamilton, Is making an effort to
secure bail and release pending appeal to
the supreme court for- another trial. Balrd

In all cases amount to $5,200. He ha in
fluential friend who are working for him.
Judge Nichols fined W. A. Richards, who
was Implicated, It Is alleged, with Balrd.
and his brother, Bert Richards, each $300
on their conviction for Illegal sales of
liquor. They , were running a liquor Joint
at Hamilton at the time of the robbery.
Farmer Killed by Lightning.
FORT DODGE, Ia., May 20. (Special Tel
egram.) Ira Neal, a young farmer, was
struck by lightning and Instantly killed
In a terrlfle storm ot Hvermore this after
noon. Young Neal wa working In a field
when the storm came up. His horse was
also killed. Hailstones fell in Llvermor
eight Inches in diameter. There Is hardly
whole window light left In town and
much minor damage was done.
Disbarment is Proposed.
MOUNT PLEASANT, Ia.. May 20. (Spe
cial.) A committee of the local bar pre
sented to Judge Smyth a petition for a
committee to prosecute disbarment pro
ceedings against the firm of McCotd A
Flnley on account of alleged Irregularities
In connection with a recent lawsuit. The
court suggested that the charges be made
specific and a committee of the bar la pre
paring them now.

while repairing a Chicago ft Oreat Western
car on th sidetrack.

CEDAR RAPIDS, May . (Special.)-In
the business session Of the department en
campment. Grand Army of the Republic,
which opened here this morning, th an
nual report of various officer were pre
sented and referred to appropriate com
mittee. The encampment wss presided
over by John Llndt of Council Bluff, de
partment commander, and he compli
mented ajl the subordinate officers and th
Grand Army worker on th work of th
past year. Indicating that the showing ot
work done wes better than for many years.
He commended the movement for a mem
orial to Dr. Stephenson, founder of th
Grand Army of the Republic, recommended
th adoption cf a souvenir badge for th
department, urged that member take
pain to enforce the law against non-member
displaying Grand Army ot th Re
public emblems, expressed a desire that
there be renewed effort to Increase mem
bership, and gave detailed Information re
garding . the plan for th trip to San
Francisco to the national encampment. He
also made a very important recommenda
tion to the effect that a legislative com

amining th Iowa cod to see it there I f
any occasion for amendment In the mattet
of giving preference to old soldiers in offi
cial position. .
"On year ego," said Commander Llndt,
"In th capital city of the state you elected
the present administration to take com
mand and have charge of the business ot
the department. How well we have per
formed that duty will be shown by. the
report of the department officer. A a
result of the arduous work of my pre
decessors and the fact that there was no
session of the legislature during my term
saved me much labor and effort, conse
quently my report will be brlei. At the
commencement of my administration there
were In good standing In this department
12.378 member. There have been added
during the year by muster Ave posts and
1,184 members. V'e have lost six posts
and by deaths, transfer and suspensions
1.238 members, leaving in good standing
SSS posts and 1.1,570 members. This Is a net
loss of only 75, a better showing than has
been made for several years. Many poets
have made a large gain from their sus
pended lists, showing what could be ac
complished In the department if the posts
would all show like activity. ' i
"The finance ot the department are In a
prosperous condition. We have $4,30) In
note secured by first mortgage on farm
land. Wa had at the commencement of
my administration $1,236. tl. and we had at
th cloae $2,069.63. The expense during the
year have been reduced $203.17. a showing
that we consider very creditable consider
ing the fact that for the national encamp
ment a much longer distance was traveled,
necessitating greater1 expense.". , . f

In regard to the noldlere' home at' Mar
shalltown he' Stated that' he had visited
that Institution In company with the com-
! mlttee appointed for that purpose, and had
found "everything as, satisfactory as could
b expected In an Institution of this kind."
The comrade are a comfortable and
happy aa they can b when cared for out
side of their own homes." He especially
commended Commandant C. ?. Horton and
Dr. Duffleld, the surgeon In charge. In
regard to the Sohs of Veterans he said:
"As to the Son of Veterans, the na
tional encampment at Its last meeting tn
Washington, having declined to admit
them In membership to the Grand Army of
the Republic " we cannot recognise them
officially; but It Is the duty of every com
rade In this department and everywhere
else to glve them all the assistance in his
power and to aid in maintaining every or-
ganlsation. and to encourage them In
their good and tioble work."
Commissioner Llndt also spoke a good
word for th Women' Relief corp and th
Ladle of the Grand .Army of the Republic
and urged that every post should have
one of these auxiliaries In connection
therewith. He also especially commended
the good work of his assistant adjutant
general, George A. Newman, and his as.

RAWLINS, Wyo., May l0.-(SpeclaI Tel
egram.) The copper shop and storehouse of
the Union Peelflc shops was destroyed by
I fir early tonight. The building wa a large
frame one, filled with Inflammable material
and burned fiercely. Nevertheless the fire
department mastered the flames and saved
the foreman's office and the paint shop,
which were In another frame building par
allellng the burned building and not more
than eight feet from It. At one time
looked as If the new roundhouse and the
blacksmith and machine shop would be
burned, but they were saved by hard work,

received at tne Maritime exenange an
nnunrea that tha British bark Skoda ha
arrived at Black river. Jamaica, and re.
port that on April 30, IftO mile off Cap
Charlea. It passed through water covered
for mile with oil. This probably explains
the loss of the tank steamer which left
Sabine Pass March 19 for1 Marcus Hook
La., loaded with oil. Since the date
sailing Luckenbach haa not been heard
from and has been given up for lose , It
carried a crew of thirty-two men.

DES MOINES, May 20.-(Speclal.)-The
annual meeting of the State Board of
Health and its associate body, the State
Board of Medical Examiners waa com
menced today. Th report of Secretary Ken
nedy was read, In which he outlined his
biennial report to be made to the governor
for publication, and stated what prepara
tions he had made for the biennial report.
The work of the year was discussed and
general satisfaction expressed over the
condition of th state as to health. New
offlolals ot the state board will be elected
tomorrow.
The annual meeting of the State Hahne
mann Association of Homeopaths com
menced today also in this city. Addresses
of officer and th reports wore read. Tha
legislative committee reported on the work
don and plans for new and necessary leg
islation, and this evening th member of
th association were banqueted.
The annual meeting of the State Associa
tion of Photographers also commenced in
Des Moines today, and the preliminaries
wr gone through with. .The association
was to have been welcomed by the gov
ernor, but he had an engagement at Cedar
Rapids and waa not present. The associa
tion has a large exhibit of photography,
for which prises are given.
Man and Wife Lose Each Other.
An Interesting case of getting lost turned
up here today. Charles Hccker was mar
ried to Lydla Johnson in Waterloo three
months ago. A few weeks ago they came
to the city In search of employment. She
went to work as a domestic servant and he
went out on a farm. They had arranged
to both go to the farm. He came to town
Sunday to get her and found ehe had gone
away. He haa traced her about the city
and found where she ha sought work, and
the persons to whom she applied claim that
the young wife wa also In distress be
cause of her Inability to find her husband.
Both are very young. He was a soldier In
the Philippine war. It appears, therefore,
that both are searching and that they have
become a completely lost to each other aa
If they were in a wilderness.
Democrats Will Reaffirm.
The caucuses have been held for th Folk
county democratic convention, which will
be held here Saturday. It 1 found that
practically none of the reorganlzer will
attend the convention, and that the men
who Insist on reaffirming th Kansas City
platform entire will hay full and undis
puted control ot the convention. Sine the
Jefferson day banquet, when Bryan cam
here for the purpose of preventing any com.
promts In the state convention, the re
organisers have generally given up and
say they will not make any effort to keep
the convention from reaffirming this year.
C. O. Holly, a radical free sliver man and
socialist, Is to be the temporary chairman
of th county convention.
Supreme Court Decisions,
Th supreme court today affirmed the
case of Livingston & Schailer against Em
niett Heck, from Shelby county. Th
plaintiffs, who are of South Omaha, had
sold 113 head of cattle to the defendant
and he had given a mortgage on them and
taken them to Harlan. He afterwarda
sold thirty head of th cattle, but did not
deliver the goods until after the mortgage
had been filed. The company sued to re
cover,"t)ut It was shown that th company
had given Heck authority to sell the cat
tl notwithstanding th mortgage, and that
the firm knew of the sale, hence cannot
recover on this action.

Reduced III Sentence.
At the January term of the supreme
court a reversal wa found In the case of
the State against Henry Kuhul, from Scott
county. He had been convicted of an un
speakable crime and had received life sen
tence. Word was received today that he
had just been sentenced again after hi
second conviction for the same crime and
that Judge House had imposed on the con
victed man a penalty of ten years' Im
prisonment. He ha gone blind and the
Judge remarked that it would appear that
God had anticipated the court in Inflicting
punishment.
Railroad Report All In.
The last of the railroad report "to be
filed with the state executive council ap
peared thla morning, which complete th
records on which the council will make
the assessment. The report of the Chicago,
Burlington A Qulncy road was filed. It
ahowa that on tha main line and all It
branches tn the. state of Iowa, Minnesota,
Wisconsin, Illinois, Missouri and elsewhere,
the gross receipts amounted to $24, 477, 158. 88;
the expenses, $15,440,004.86, and the net earn
ings, $9,037,164.23, Or $5,800 per nlle. On 'the
business done in town the receipts, were
$11,004,965.54, tho expenses $3,830,391.11 and
the net earnings, $2,174,564.43.

bottom bridge which span the Susque
hanna river in this city, went down today
under the weight of a street car.

son county, are searching for Henry Me
Keeley, the brother-in-law of Dode Kinn
yon, a 17-year-old colored girl, who was
found murdered at her mother' home.

dered while her mother and sister were
away. McKeeley. who was known to b
at the house at the time, disappeared soon
after the girl' body was found.
