City Assessor F. F. Everest bus received
ntlce from J. H. Daniels, treasurer of the
Omaha nridge & Terminal company, that
9D second consideration the company would
pay the city taxes assessed on the esst half
of Ita bridge across the Missouri river. The
notice received .by Assessor Everest was
purely unofficial and nothing has bern said
so far to County Treasurer Arnd by Mr.
Daniels or any other officer of the Terminal
company on the matter.
Treasurer Arnd said yesterday that the
:ompany had not yet paid the city taxes on
the bridge and that all he knew about the
natter was that Assessor Everest had told
aim that Treasurer DanlPls had stated the
sompany had reconsidered Its decision not
io pay. He said he was glad that the
Terminal company had reached this de
:tslon as It saved lengthy and expensive
litigation. The refusal of the Terminal
company to pay the city taxes on the Iowa
end Of the bridge was based on the ruling
of Judge McPherson In the Union Pacific
bridge case, which ruling was sustained
by the United Stales circuit court of ap
peals. The conditions surrounding the
eastern termini of the two bridges, how
ever, was materially different and the fact
that property Immediately adjoining the
eastern terminus of the Terminal company's
bridge paid municipal taxes led the Ter
minal company to change Its mind and
consent to - pay the city taxes assessed
gainst the bridge.

The news of Mr. Batnbridge's appoint
ment came as a great surprise to his
friends in Council Bluffs, as It was not
anticipated when he left here a week ago
for Washington. From Washington Mr.
Balnbrldge Intended to go to Europe, where
he had planned to study diplomacy and In
ternational law for a year. Mr. Balnbrldge
only recently resigned the position of sec
ond secretary of the United States legation
at Pektn, China.

Roadster Meeting; Postponed.
Local owners of harness horses met last
evening at the Kiel hotel for the purpose
of reorganizing tho Council Bluffs Roadster
club, with the Intention of holding driving
matinees at t'nlon Driving park during
the summer. The meeting was well at- 1
tended, but owing to the absence of W. H. I
Ware, secretary of the old club, who has 1
in his possession all the papers of tho !
organization, it was ' decided to postpone
definite action until next Tuesday night,
to which time the meeting adjourned.

The Council Bluffs Retail Grocers' as
sociation has placed itself on record as be
ing opposed to the city granting any In
dependent telephone company a franchise
which calls for the establishment of an
other exchange In the city. The association,
however, declared itself in favor of a toll
system which would give Council Bluffs
connection with the Independent companies
in Southwestern Iowa.

Two Heavy Humane Salts.
ONAWA, la., April 3. (Special Telegram.)
Two damage suits for lnrge amounts were
filed In the office of the clerk of district
court of Monona county today. Gunner
Skow of Soldier, la., brings suit against
Swen Andrew and Gena Swanson for $5,000
damages for malicious prosecution of Skow
for larceny, and for slandering plaintiff's
character. Henry C. Peterson, a restaur
ant keeper of Onawa, sues George Wirt,
and J. W. Hahne, for 85,000 damages for
Injuries received in a row at his restaur
ant on March 7. The Hahne brothers
are prominent farmers of Monona county
who formerly lived in Omaha, and the
case has attracted much attention.

Judge John F. Oliver today Issued a
temporary writ of injunction In which the
school townsnlp of Jordan Is plaintiff and
independent school district of Soldier, and
A. D. Smith, county treasurer, are de
fendants, enjoining defendants from collect
ing and paying taxes to the Independent
district school of Soldier, as the establish
ment of said district of Soldier was Illegal
and contrary to law.

Mrs. '..Catherine Barrett,' the oldest woman
In the stato of Iowa, lies very near death
at the home of her daughter, Mrs. Patrick
Mullen In Eagle township. She suffered
a stroke of , paralysis a few days ago and

birthday and may be older The records

Case on Trial.

DES MOINES. April 8 (Special.) Gov
ernor Cummins today decided definitely
that all the companies and the band of
the Fifty-fourth regiment of the Iowa
National guard will go to St. Louis the lat
ter part of the month to participate In the
parade at the dedication exercises. Gen
eral Bycrs and . Major Hume returned
Thursday morning from 8t. Louis, .where
they had gone to make an investigatlcn of
the preparations for the care of the sol
diers. They had been informed by letter
from those supposed to be In authority
that Iowa troops might go Into camp and
receive commutation pay instead of being
kept by the management; but on arrival
at St. Louis they found this was not the
case and the Iowa troops will have to go
Into the exposition buildings as temporary
barracks. A conference was held this
morning between the governor and the ad
jutant general and it was decided that or
ders should immediately be issued for the
Fifty-fourth regiment to go to St. Louis.
Tho companies will bo directed to proceed
to St. Louis April 29 and be In camp and
ready for the parade on tho morning of
April 30. Colonel Caughlln of Ottumwa
will be la command, with Lieutenant
Colonel Bishop, and Majors Lambert, Dun
lap and Wetherell. Captain Wclherell is
before tho examining board' today for ex
amination brfore be)ng commissioned ma
jor of the regiment, he having been elected
last week to that position. The regiment
will be directed to remain In barracks on
the exposition grounds until May 3. Gov
ernor Cummins and the entire military
statT will attend.
Contrart for Stte Warehonse.
The state capltol commission this after
noon let the contract for the erection of a
warehouse on the site of the heating plant
near the state capltol. The building will
cost a little less than J29.0Q0. The bids
were all from Des Moines. Capital City
Brick & Pipe company, 828,475; W. F. Mit
chell, J3G.4GO; W. II. Brereton. $42,097;
Charles Weltz & Sons, $31,800; Benson &
Marxer, $35,622. The contract went to the
Capital City Brick and Pipe company for
$28,475.
Cummins Invlfeit to the Beneh.
The statement Is in free circulation here
that one of the chief purposes of President
Roosevelt In inviting Governor A. B. Cum
mins to go to Washington in February was
to offer him the position on the bench now
held by Judge Caldwell, that of circuit
Judgo for the Eighth circuit. This state
ment comes direct from those who are
familiar with the situation and claim to be
in the confidence of the governor. It is
understood that the Iowa delegation In
congress has indorsed Judge Smith Mc
Pherson for this position and that It Is de
sired he shall be' promoted to the circuit
bench. There are; many, however, who are
confident that OdVernor Cunmins even now
has the refusal of the position and that he
may yet conclude to accept It. Governor
Cummins has not' made any .statement in
regard to the mAUvr. V

The case of the State against Armour
j Packing company Is on trial in district
1 court. This is the case in which a test is
j being made by the state of the law relating
to the sale of oleomargarine colored yellow
in Iowa. The agents of tho company were
indicted for illegal sale of oleomargarine.
There was but one wltuess placed ou the
stand for the state, the state dairy com
missioner, and be testified as to the pur
chase of the stuff in tho markets and as
to the law in the case. The solo q'loslion
at Issue was whether the oleo is in fact of
a yellow color, and if so It Is being sold
contrary to tho Iowa law. The Jury will
get the case tomorrow.

who was charged with the crime of embezz
lement by his wife, on February 25, and
left the country, was arrested at Sloan
today and brought to Onawa.
He will have a hearing before Justice
