Judge Jacob Fawcett of the district bench
Is In Omaha for a day or two, after which
he will return to his mining Interests, fif
teen miles from Whitney, Ore. The fact
that he was soon to return to Oregon re
vlved the rumor that he proposes to resign
hie place on the bench, tmtr this the Judge
emphatically dentea, saying:
"Within three days after I return to
Oregon I expect the mill we have built to
be put Into operation and I go there again
only to make sure that everything starts
off right. ' I shall return to Omaha about
tbe holidays to rearms my place on the
bench here and all talk of '-ay resigning
can be discounted as unfounded rumor.".
The Judge'g chair in courtroom No. I will '
be occupied during hie absence by Judge
J. P. Boyd of Nellgh, who was eleeted to
the bench on the republics ticket by
nearly 800 majority In a Judicial district -which
had previously been populist by
1,100 majority.
The first case, to occupy his attention here
is the suit of J.' I. Tamlhoilan Co. against
the Northwestern road for $1,200 damage,
alleged to have been sustained by plain
tiffs when the company failed' to make
prompt delivery of goods shipped from
Sioux City to Cedar Rapids, la., to bo sold
there as a sale which had been advertised,
but which had to he called off because the
goods were not on band.
