Lotwck, fuslonlst, has taken the first step In his effort to wrest from Henry 8. McDonald, republican he certio rate of election as commissioner from the Fifth commissioner district, which certlfl rate was Issued McDonald last Thursday soon after mandamus proceedings In Judge Estelle's court. Lobeck has filed In county court a petition praying that the "pre tended -lection" of McDonald be annulled nd that he (Lobeck) be declared the person duly elected In his allegations the petitioner Ignores the close returns which occasioned the re cent court proceedings and makes, as re quired by law, the general claim for five more votes than, he was allowed In' each precinct of the district because of Incorrect counting and admiRslon of Illegal ballots. With his petition Lobeck fll "1 a bond for costs with John Grant as the surety. The law requires thfct petitions be Bled t least ten days before the beginning of the term In which the case Is tried in county court, and as county court terms begin on the first Monday of each month, the prsponed contest proceedings cannot be reached until the January term. Commis sioner Ostrom's term expires January 7 and, McDonald has a certificate of election, but Lobeck hinted Saturday morning that McDonald would never be permitted to take the seat until the contest proceedings aro over. College Entertainment. The first of a series of concert pro grams was given at the Omaha Commercial college, 17th and Douglas Sts., Friday even ing. The spacious tails of the college were beautifully decorated with the college col ors, buff and lilac, and numerous potted plants were tastily arranged. The evming's entertainment consisted principally of music by the college or chestra, under the direction of Prof. F. M. 6teitihauser. Thin, however, was Inter spersed with some choice selections In the way of solos, recitations, etc. J. Saly and Director Stelnhauser each rendered splen did singing, and Leon Felgar, the baritone, entertained In his usual charming manner. Prof. A. C. Mueller also demonstrated that he has lost none of his old-time skill In handling the ilther. Prof. O. M. Ritchie Is so well know that his appearance upon the stage was signal for an outburst of applause and a hearty encore. Something out of the ordinary was given in the club winging exhibition by Prof. Fox, Miss Cox and Mr. Cray. Between numbers on the program things were'ept lively by the students giving the. college cheers. More than 600 persons were In attendance and no public enter tainment recently given In the city baa been more heartily enjoyed. The Paxton A Gallagher company has de cided to tear down Ita present building In which Its wholesale grocery establishment la located, facing the Tenth street viaduct, and replace It with a new and modern office building and warehouse. This fact was brought out Friday In a statement by Charles II. Pickens, who Is the active man ager of the concern. "We have outgrown our building," said Mr. Pickens, "and It no longer meets our needs. We must have larger and more sub stantial quarters In the very near future. We would start to work at once to put up a Dew building if we could find some suitable place for temporary occupancy while the new building Is In course of construction. We have gone all over the wholesale dis trict, but' have been unable to discover an available building. We will have to tear down, our present quarters, however, and erect new onea on the site within another year, even If we are compelled to put up a temporary structure to accommodate us in the Interval." 18k wedding rings.
