Th Maccabee celebrated the dedication
and opening of their new hall In the Brown
block last night with a ball which was
attended by a large crowd. Many member

Howard Conner, of the clerical force at

giving. Justice Bryant decided yesterday that
Miss Anna Rhody waa not guilty of

woman, who had been arrested at her home'

Scarcity of Juror necessitated the Issu
ance yesterday of a wecond special venire.
By agreement the suit of Joseph Lauder
against I B. Cousin, sheriff of Potta
wattamie county, I being tried before
eleven Juror. The ult 1 to replevin a
delivery wagon and team of mule attached
a year ago on a Judgment obtained by a
milling firm against the Lauder Baking;
company of Omaha.
The fire department wa called at 2
o'clock yesterday afternoon to a one-atory
brick cottage at 421 Harrison street, owned
by J. W. 8qjre and occupied by A. G.
Gale, where a blare had started In one
of the closets. The fire was extinguished
by the chemical engine. The loss on the
building is estimated at 1100 and about the
same on the content of the closet. It la
not known how the nre started.
Fred N. Lewis, ion Of 8. F. Lewis of
Macedonia, this county, will have a hear
ing this rooming before the commissioner
for the Insane on an Information filed by
his father. Lewis, who la a civil engineer
by profession, has been a private patient
at St. Bernard's hospital for a month, but
hi condition has become worse. His de
mentia Is believed to be due to overwork
last summer while in Dakota engineering
and speculating In land.
The Chicago, Burlington St Qulncy Rail
road company has filed in the federal court
m motion to consolidate the three suit of
J. H. Lowder, Mr. Addle Lowder and R,
Howell, guardian of Mrs. Lowder. The
suits are for JJO.OOO each and arise out of
Injuries received by Mr. Lowder in a
wreck near Hastings, la., about a year ago.
The suit were originally brought In the
district court, but on motion of he rail
road company were transferred to the
United States court.

J. J. Stewart, who was appointed ad
ministrator of the estate of Thomas Officer,
senior member of the defunct banking firm
of Officer Pusey, In place of Charles Offi
cer, baa filed a report covering tho period
from the date of hi appointment to Oc
tober 31. The report shows that on October
31 Administrator Stewart had on hand
$11,920.01. and that all the real property
belonging to the estate bas been sold, ex
cept three Improved lota and three unim
proved lot In thla city and a farm In Rock
rounty, Nebraska, which I of uncertain
value.
The administrator reports that he ha
made every effort to reduce thla real estate
to cash, but up to date ha been unable
to complete the sale. Once tbl Is done,
he says, and the collection of a few minor
notes effected, the estate can be closed
up. with the exception of the mining in
terests. Regarding the mining properties, Admin
istrator Stewart, who went to Colorado
and made a personal Investigation of them,
says: "The property consist of the Bertha,
Blake, Longfellow, Percy Chester, Golden
Wonder, Pargolds, Percy Chester No. 2 and
Mabel lodes, covering approximately
twenty-two acres of ground. The value of
this property I somewhat problematical.
The property Is situated in Eagle county,
on Eagle river, along the bank of which
a railway track furnishes ready facilities
for loading the ore. There being but one
railroad company operating In that Tlclnlty
and no competition, the matter of freight
Is a proposition that Is controlled exclu
sively by the railroad company and which
bas much to do with the value of the ore,
a alj of It must be shipped to the smelter
over this line."
Only of these mines ha been worked
and this, the administrator says, appear
to be Inactive at the present time. In
concluding hi report Mr. Stewart says:
"The value of the raining property I
necessarily an lnteretlng and important
feature In the affairs of this estate, a it
I clearly Insolvent unless there I realized
out ot thl property an amount that cannot
at this time be safely prophesied."
Since bla appointment Mr. Stewart has,
under the order of court, paid a dividend
of 5 per cent, and If the real estate now
unsold can be disposed of, possibly he may
have sufficient to pay another dividend ot
the same amount.

Next Sammer.
The retail druggists of Council 'Bluffs,
who will be called upon to entertain the
Iowa State Pharmaceutical association
next year in this city, effected a tempor
ary organization last night at a meet
ing In Mayor Morgan's office, with O.'H.
Brown as chairman and George 8. Davis
as secretary. An adjourned meeting will
be held next Tuesday evening at the sam
place when It Is hoped to effect a perma
nent organization.
At the meeting last night It was decided
to fix July 9, 10 and 11 for the meeting ot
the ststs association In this city next
summer, these being the dates on which
the annual meetings have been held for the
previous two years. O. H. Brown was se
lected to act as local secretary of the stats
association for the purposes of the an
nual meeting and O. S. Davis, J. I. Henry
and J. Camp were appointed local members
ot the committee on sports. They will act
in conjunction with O. 0. Harlan ot Storm
Lake and J. F. Kline of Sioux City.
Those present favored holding the busi
ness sessions of the stats association In
Royal Arcanum hall and having the head
quarters at the Grand hotel. The sports
will undoubtedly be held at Lake Mawana.
While nothing definite wa decided upon at
last night's meeting plans for entertaining
the visiting druggists were discussed and
It is practically agreed upon that one of
the features would bs a grand ball on one
ot the three nights of the meeting.

Elks Preparing; for Memorial.
Hon. Henry Vollmer of Davenport. Ia.,
will deliver the principal address at th
memorial exercises of the Council Bluff
lodge of Elks to be held Sunday afternoon,
December 7. Rev. George Edward Walk,
rector of St. Paul's Episcopal church of
this city, will also deliver an address. Th
musical program, which I in the hand ot
Clyde B. Altchlaon, has not been definitely
arranged. There will be selections by a
male quartet and two or three solos by
vocalists of reputation. The committee in
charge of the exercises is considering the
advisability of holding them in the opera
house and this will probably be dons sf
suitable arrangements can be made with
the manager of the house.
Tonight, after the business meeting, the
lodge will bold a social session, for which
a splendid program has been arranged by
the entertainment committee. Several ot
the artist now appearing at the Orpheum
in Omaha will be on the program in addi
tion to local talent. The members cf the
Omaha lodge have been Invited to be
present and th festivities will commence
at 9:30 o'clock, to be followed by a ban
quet, which will be served in the base
ment ot the clubhouse.

Lewie Smith, the negro awaiting trial
tor the murder of Charles Edwards, an
other negro, st Avooa last summer, who
wa placed in the county Jail here for
sate keeping, la proving a most trouble
some prisoner. Jailer tlartln has on more
than one occasion been forced to punish
Smith by placing him on a bread sod
water diet and by confining him la a soli
tary celL Smith refuses to obey the prlsoa
rule and has repeatedly tried to Incite
the other prisoner to rebel against the
rule of the Jail. Tuesday night Smith,
after having been troublesome the entire
day. rapped the climax by setting fire to
his bed clothing, which was practically
rendered worthless before Jailer Martin,
assisted by other prisoners, succeeded lu
extinguishing the flames.

pital a few hour after being 'rought there
from a grading camp on the Great West
ern near Shelby. Yesterday a stranger,
after looking at the corpse. Informed Mr.
Lunkley that he believed the boy s name i
wns Whitney snd that his relatives lived
in Little Sioux, Is. He gave Mr. Lunkley
the name of Alf Whitney as being possibly
the father of the dead lad and Mr. Lunk
ley has written to Little Sioux giving a
complete description of the boy. At the
time the boy was brought to the hospital.
It waa said that his name was thought to
be either Wltten or Whitney.

The game scheduled for Saturday after
noon at Lake Mawana between the Coun
cil Bluff and Omaha high school has
been called off by Omaha, much to the dis
appointment of the Bluff boy who were
expecting to retrieve their defeat of ear
lier In the season. The Council Bluffs boy
have secured a game with the high school
at Creston and will go there Saturday.
Manager Rutherford of the Dodge Light
guards foot ball team is negotiating for
a game Saturday afternoon with Morning
side college of Stoux City, to be played at
Manawa.
Debater Select Side.
At a meeting last evening of the team
which will, represent the Council Bluff
high school In the debate with the Sioux
City high school next January It was de
cided to take the negative lde of the
question, the selection 'of sides being the
privilege of the local team. The question
to be debated Is "Resolved, That the United
States is not Justified in retaining perma
nent possession of the Philippine (elands. "
The exact date for the debate, which
will be held in this city, ha not been de
cided upon.

No Trace of Cashier.
WATERLOO, Ia., Nov. 19. (Special.)
No trace has been found ot Waldo Miller,
the missing cashier for the Chicago Great
Western road at this place. It Is the gen
eral opinion now that he either committed
suicide while temporarily insane or fell
through the Fourth street bridge Into the
river while going from his work. A check
ing of his accounts finds them in correct
condition and no cause can be assigned
for his strange disappearance.
Woman Accused of Aaaault.
LA PORTE, Ia.. Nov. 19. (Special.)
Mr. Ben Levell is under arrest on the
charge ot attempting to murder Walter
Jaggett. Mrs. Leveil's husband and Jag
gett engaged In a fight and Levell was get
ting worsted, when his wife came to the
rescue with a hatchet. Jaggett, although
chopped, will recover.

DES MOINES, Nov. 19. (Special.) The
Great Western passenger train from the
south, which is due to arrive here this
morning, was delayed two hours by an
accident which happened at Benton In
Ringgold county. The accident was fort
unate In that It might easily have been
much worse. The passenger train had
four regular coaches and two empty
coaches at the rear. It was standing at
the station when a double-head freight
train ran into the rear of the passenger
at high speed. The two empty coaches
were demolished, but ss they were not
occupied no paasenger was Injured. The
front englno of the freight train was
ruined. The fireman, William A. Shaffer,
was injured so badly thst he died soon
afterwards. The engineer, C. C. Squire,
was badly scalded and bruised, but will
not die. Several ot the freight cars were
injured in the smashup. The cause of the
collision Is not known.
City Administration Accused.
The Levlch murder case turned strongly
today in the direction of showing a con
nection between the murder and the fact
that the man killed had been most active
In prosecuting the gamblers and compell
ing tho city administration reluctantly to
close up the gambling places of the city.
At first the court refused to allow testi
mony in regard to this matter, but later
decided to admit it all as having a bearing
on the case. Testimony was introduced
Knowing that some of tho gamblers had
protested to Finkelsteln that he was doing
wrong in prosecuting them and that they
threatened his life It he persisted. He
had declared that he was not trying to
Injure the gamblers, but that he wanted
the city to get the money they were pay
ing out for permission to run and not the
city officials personally. A vast amount
of testimony Is being introduced to show
that Finkelsteln had been threatened and
that he received letters telling him that
he would be killed.
Wealthy Convict Forfeits Bond.
At a recent session of the supreme court
the case of the State against Hubbell O.
Soper ot Dixon, III., was affirmed. He had
been convicted of conspiracy with others
to secure money from various residents of
Washington county to pay for county and
township "rights" in a patent washing ma
chine. It was found the machine was
worthless and that the commendations and
indorsement were fraudulent. Soper was
wealthy and had furnished the money to
carry on the business, which had been
worked systematically In several counties.
Other were indicted with him and a test
was made, of his case. It is now learned
that as soon as' he heard of the supreme
court decision, which would compel him to
serve two yeara in the penitentiary, be left
his home in Illinois and all efforts to locate
him have been futile. The case attracted
a great deal of attention because of the
prominence of all the parties concerned
and because there was a close question a
to whether it was a conspiracy case.
Names a New Referee.
Judge McPherson today named S. 8. Eth
ridge ot Des Moines to be referee In the
Gluckllch bankruptcy case at Perry, In
place ot Halilgan, removed. This Is the
case In which the court severely censured
all who had a part In the case because of
the delay and the disposition to make tees
rather than to accomplish results. He
ordered a special investigation to be made
of the case and an Immediate report on
whether or not further suits should be al
lowed In connection with the bankruptcy
proceedings.
The patent infringement case ot the Mor
rison Manufacturing company of Fort Mad
taan against the Deere Plow company of
Rock Island was decided in favor of the
plaintiff by Judge McPherson. The defend
ant company claimed that the device pat
ented had been In use prior to the taking
out of the patient, but Judge McPherson
held the patent good. It Is a device to. bold
the plow in the furrow.
Boy Kill Gray Eagle.
CRESTO.V, Ia.. Nov. 19. (Special.) Bert
Roe killed a grey eagle just north of here
yesterday that measured seven feet from
tip to tip and whose legs were as big as a
man's arm. The bird was only wounded
at first and mado a desperate fight before
it was killed. How it came so far from its
native haunt is not known, but it 1 sup
posed to have followed a flock of wild
ducks or geese from the north. It will be
mounted and kept as a curiosity.

conflict In the date with the federal court,
was convened here yesterday, with Judge
Parrlsh on the bench. The docket Is a
light one, with but two criminal cases.
The day was taken up In assignments snd
disposing of deiault cases. Four decrees
of divorce were signed and the case of
Teddy DeVoe, the 14-year-old boy robber,
was bound over on the charge of assault
and robbery, with a recommendation that
he be sent to the reformatory, was heard
snd decision reserved. It Is thought that
the session will end this week.

CEDAR FALLS, Ia., Nov. 19. (Special.)
Suspended from tho cable ot the Cedar
Valley Telephone company, thirty feet
above the brick pavement, with nothing
but blue sky above and space below. Will
Webb, a telephone lineman, deliberately
went on a spree by drinking the greater
part of the contents of a quart bottle of
whisky yesterday evening Just before dusk.
This is the first spree Webb has ever
taken while In the employ of the telephone
company and it Is the last, for he was
fired on the spot.
Manager E. M. Grotopp cf the telephone
company risked his own life to rescue his
drunken employe by using a swinging plat
form such as Webb was seated on. Webb
was fifty feet from any pole and thirty
feet above the ground. By pulling his own
car and that of Webb's Grotopp succeeded
In getting the drunken man to the pole,
where Bert Archer, manager of the Iowa
telephone line; a lineman named Jones of
the electric light company and Webb's son
kept the man from falling while a rope
was being secured with which to let him
down.
Webb's son was frantic with fright and
when his father slipped from the cross
beam and was only saved from falling to
the ground by Bert Archer, who caught
blm by one wrist, he could stand the
strain no longer and left the scene.
Webb was getting limp, fully overcome
by the liquor, and bis rescuers resorted to
heroic measures to stir up bis sensibili
ties by trying to make him angry and suc

Mrs. Clara Hazelrlg, a woman evangelist
from Topeka, Kan., is creating quite a re-i
llglous excitement here. She la the first
woman evangelist to hold meetings in Cres
ton and her talks are instructive and Im
pressive. She Is assisted by MIbs Graves,
a singer and choir leader from the same
place, and the audiences, which are nightly
growing, tax the capacity ot the Christian
church. Already thirteen have united with
the church under her preaching and every
night sees from one to six make confession.
