McHugh of Omaha should appear before tbe supreme court of the fnlted Ptates and ask for writs of certiorari upon vi tally different Vases, but affecting Interests of citlsctis of Nebrasks. Mr. McGilton will appear in the aupreme court on MoDday te ask for a writ certifying up to the supreme court the rasa of the United State Fi delity and Guaranty company of Baltimore, Md., against the Omaha Building and Con struction company, and others. The case grows out of construction cf an addition to the Inacre aayliim at Norrolk. The Omaha Building and Construction company exists, according to the brief of plaintiff in error. In the person of J. K. Rellly. Tho contractor failed to pay labor and material bill aJ the guaranty company waa compelled to do so under Its bond, and seeks to recover. Mr. McGilton, as attorney tor the guaranty comnany, eeeks to transfer ths case from the circuit court of apnea la to the supreme court, for the reason that there has been no authorita tive utterance by the supreme court on the question Involved. W. D. McHugh will put a motion for a writ of certiorari to the supremo court oft Monday on behalf of tbe Chicago Houeo Wrecking company against Otto C. Blrney.
