By reason of the fact that th health de
partment took charge of the Vendoma hotel
In thl city for quarantine purpose at th
time of an outbreak of smallpox in that
house In February, 1890, and continued la
control there for the period of about one
month. Andrew J. Hattery and Carrie Hat
tery, who were proprietor of th hotel at
that' time, have brought suit In the dis
trict court against the city of Omaha, de
manding damages In the sum of $4, 76. 78.
The petition states that the Health depart
ment took full control of th hotel Febru
ary 2, 1899, and remained In exclusive man
agement of the premise a a quarantine
hospital until March 3, 1899, using through
out that period the fuel, lights, furniture
and other accommodation belonging to
the plaintiff, besides preventing th plain
tiff from carrying on th regular business
of the hotel.
