William foea. the condemned murderer who Is a el ting execution at the penitentiary. was Identified thla afternooa aa tbe inaa who under tbe name of Hamilton. was con victed In Baunden county of burglary and who eecsped from jail a few day after being aentenoed to five year im prisonment at bard labor. The over nor Laa promised that thla Identification will hare weight with him In determining whether or not Rhea'a sentence abould be commuted. He will likely announce his declalon tomorrow or next day. The men who identified tbe prisoner came with a delegation from Dodge county this morning. Among the members of this delegation were Emll Zahn, brother of the murdered man; Former Representative Barnes and his son, who fired tbe shot that wounded Rhea aa be was attemotlng to escape after the murder; Judge Barry, the examining magistrate who bound Rhea over to tbe district court for 'trial: Sher iff Mc Bride of Cass County, who has official knowledge of Rhea's csreer; Judge Blama. Conrad Schneider. George Scott and aev eral others. They arrived at 11 o'clock and went directly to the state bouse, where they bad an Interview with tbe governor. At I o'clock this afternoon the delera tion, accompanied by R. J. Clancey. private eecretary to tbe governor, went to the penitentiary, and there after a few min utes delsy, Rhea was positively Identified. First the delegation was shown a convict tinder sentence for some other crime and were told that be was the man tbev were looking for. Immediately every man of them gave a negative nod. and a few mln 'utes later another convict was hmue-ht .forth, but still tbe men were unsatisfied. Finally Rhea was brought before them and they all recognized blm at once. Tbe delegation bad another Interview with tbe governor after returning from tbe penitentiary, at which tba details of tba murder were gone over with exactness. Tbe governor promised to give respectful con sideration to everything be bad beard and Intimated that a decision might be ex pected soon. Gwveraar Starve Talk. I Hattle Harklns wss arrested about i o'clock thla morning by Policeman John Fltxpstrlrk snd P. J. Hansen and con fined in jail. This afternoon she was brought before Police Judge Archer, charged with disturbing the pesce by being I drunk and disorderly. She pleaded not guilty to the charge. A number of witnesses testified to being In the Hotel Riley saloon between 1 and I o'clock thla morning and that they ssw her there, that afterward Antone Nltka, the bartender, and she went to the gam bling rooms on Mala street and were ad mitted by Oeorge Polsall. She stated that she went to tbe saloon to pay for a case of beer and while there eet up the beer drinks to tbo bouse; that Frank Oreea got $26 of ber money and would not return It, and that she went to the gambling rooms to get it. The court fined tbe Hsrklns weman $19. After attending the trial Mayor Frank Morgan ordered tbe city marshal to see tbst all tbs saloons in tbe city were closed promptly at 11 o'clock p. m. Ryutsdt before his departure for tbe Phil ippines. An excellent musical program was rendered and a number of addresses de livered. E. M. .Kendall, on behalf of the pupila, presented the professor with a fountain pen as a memento of the three years be spent as a teacher in the schools here. Battery Esroate to Fort Riley. BEATRICE. Neb.. April 17. (Special Telegram.) Tbe Twentieth United States battery, light artillery, comprising 128 men, IK horses and six guns, passed through here tonight at 10 o'clock on a special train, consisting of twenty-two cars, over tbe Union Pacific. Mr. Belmont's statements are as surances as to the second, and J. P. Morgan at Company are sponsors for the third. Further. Louisville A Nashville will be operated in the future as It has been In the past, and there will be no change. J. P. Morgan at Company say positively that the present status of the road is the same as It has been heretofore, except thst J. P. Morgan controls snd directs abso lutely snd without qualification. Those who intimate that Mr. Gates might possibly make trouble in the future, or thut he la In any position to Co so, axe much mistaken. The only one to be reckoned with In the management of Louisville & Nashville is Mr. Morgan. If that fact is borne In mind there wtll be no misunder standing and no need of guessing. The situation is controlled by him, and thnt should be sufficient guarantee to every body. Charles W. Gates, eon of John W. Gates, made several trips to tbe office of J. P. Morgan Co. during the morning and conferred with Mr. Perkins. Francis Lynde Stetson, Mr. Morgan's attorney, was closeted with other repreeentstives of the firm and it was reported thst all the essen tial details between Messrs. Belmont and Gates bad been completed. Mr. Belmont had nothing to say for publication.
