The government yesterday afternoon begun
suit In United States district court against
Elmer D. Frank and bis bondsracu to recovet
13,764.39 court 'fees nlleged to have been
collected nnd not accounted for by tho prin
cipal defendant during his Incumbency at
clerk of tho United States district court Ic
this city.
-Mr. Frank held this office sixteen years,
leaving It la 1S97. Individual suits wero
brought on the two bonds given by him dur
ing thnt time. He as principal In both In
stances nhd the othor signers on each bond
as sureties In the two cases are made de
fendants. The first bond was given In 18S1 nt tus
lime Mr. Frank first entered upon Ihe du
ties of the office. It wns for $5,000, and the
sureties were David 11. Holt of Falls City,
Nob., John B, Furny ot Omaha, John L.
Webster of Omahn nnd (1. M. Lambcrtson
ot Lincoln.
Tho second bond was an additional safe
guard given lu 1SSS, This was for $10,000,
and the sureties wore II. S. Hall, George II.

tho duties of rlty treasurer the records
do not show thnt Interest on balances was
collected. From April until December
of 1900 Mr. Hennlngs 'made Interest collec
tions amounting to $5,952.70. . Of this sum
$3,158.07 was derived from city funds and
tho remainder from school funds. So far
this year Mr. Hennlngs' Interest colortlonB
have uggrcgutcd $5,696. M. The Interest
colectod on school funds amounted to
$1,836.03 mid tho income from city funds
was $3,860.48.
