should file findings of fact. Judge Crofoot
of Aberdeen was appointed master In chan
cery and, after making a careful investiga
tion, filed his report somo weeks ngo. This
report was continued and tho purpose ot
tho arguments, which commenced yester

should he entered in the case, tho question
being one of law. The Milwaukee Hnilroad

ment, govo the grounds upon which the
company objects to tho passenger and
freight rates sought to be established nnd
put Into effect by tho Stnte Railroad com
mission. The stihstanco of his nrgumelit
wns that thn fixed charges on the $t!S,000
of net earnings shown by the findings of
the master In chancery pay less than 1 per
cent on tho bonds above operating expenses,
leaving ft deficit of about 1.7 per cent
and no reward to the owners of the prop
erty. T. II. Mc.YInrtln, one of the attor
neys for tho railroad commission, Inter
rupted Kltttcdge nnd stated that the find
ings of the master covered tho business
of the company for tho years 1894, 1S95 and
1890, which were bad years for biiHlness of
all kinds, but that tho buslnesR of the com
pany since that time had greatly Increased.
Judge Cnrland declined to consider this
particular feature at thin time, but stated
that tho attorneys for the railroad commis
sioners could show It in a separate and
supplemental proceeding. Tho substance of
