XBW YOniC, May 6.-Tho interrupted
speculative advance was renewed today
with ureal violence. The Rratmcrfl, Paclllcs,
Trunk lines nnd Houthwesterns proved to
be the. most active. There waa a continued
dearth of news to account for the strength
of the market In general or Northern
Pacific In particular. There was a wind
rumor that all tho great railroad Interests
whose supposed contest for control has
raimnl din reeent violent movements In
prices, I ail come to ti compromise and there
were aboil' to consolidate all the principal
railroad systems of the whole country. This
narrowed -own somewhat to more specific
reports of progress In tho sotithweBtern
merger, and of further steps towards the
adjustment of relations In the Northwestern
railroad ileal, Northern Pacllle mnde an
extreme advance of 23 points, with no very
Important reaction on the way up. Long
strings of 1,00 to ,( share blocks were
recorded, but the successive prk'c changes
did not exceed of a point after the open
ing, when the second sale was made at a
Jump of 34 points over the llrst sale, which
was I points over Saturday. The movement
over Canadian Pacllle was apparently sym
pathetic anil reached an extreme of 13'J,
Tho Duluth and South Shore and Atlantic
rommon nnd preferred rose about 31?; points
each. Aside from these there were few
stocks which exceeded the opening prices,
among them Atchison, which rose an ex
treme, 6Vii points nnd a number of less prom
inent stocks. Pittsburg, Cleveland, Cincin
nati & St. Louis rose f.Vi points; Minneapolis
& St. Louis 7 points ,nnd the coalers gen
erally from I'i to A points.

1. White the KCncrnl rule Is that an nd

decedent's estate must prosecute actions
for the recovery of debts due the estate.
there Are exceptions to the rule, and In
the present case, held, that the order ot the
trial court, substituting an heir at law and
permitting her to prosecute the action for
her Intel est In the claim In controversy, In
her own name, the other heirs having set
tled nnd compromised theirs, was not er
roneous.
2. AVhere, during tho proceedings In an
notion to recover a debt alleged to bo due

court may properly, under the clrcum

I. Such substitution would not bo equiv

tho statute of limitations can not be In
