Ileforo Mr. Hellman's death ho wns In
tho mercantile business In Omaha and
owned much real estate. At a time of busi
ness depression ho mortgaged his real es
tate to satisfy tho claims of creditors. Mrs.
llollmnn refused to sign these mortgages
until assured that tho homestead, tho prop
erty which la now In dispute, would bo
deeded to her. Tho houso wns finally trans
ferred to Mrs. Hellmnti. After Mr. Hell
man's death David Adler &. Sons set up tho
claim that when they sold $.1,000 worth of
goodu to I lit) deceased ho listed his homo
nmong his nssels, and Isaac Myeru, the
salesman who sold tho goods to Mr. Hell
mnti, testified to this effect on thu stand.
The Adlers won tho enso, nnd tho higher
court sustained tho action of tho district
court.
Other creditors 3qught to bo secured by
n mnrtgago on Mr. llellmun's home, but In
court they tentllled that ho refused to cu
cumber tho house and said that It belonged
to his wife. It wns on Myers' testimony
that tho ease hinged, and slnco that time
he Is said to havo admitted that ho testified
falsely anil Is now nnloun to go on tho
Hi ami nnd swear that Hellmun did not list
tho proporty in question nmong his assets.

given December 13, 200 families of Omaha
will enjoy a Christmas dinner today as tho
guests of Tangier temple, Ancient Arabic
Order, Nobles of tho Mystic Shrine. At 1
'clock yesterday afternoon, from Masonic
hall, four wagons started out to the four
quarters of thu city, each wagon In charge
f two members of Tangier tcmplo of the
rdcr. In each wucon were lift v baskets.
ench basket being addressed to somo family
nnd containing a card bearing tho Inscrip
tion: "Eat nnd bo merry nnd enjoy with
us n Christmas dinner. From tho Shrlncrs
t Tangier tomplc." This card rested upon
a dinner which would not bo out of place
upon the tablo of tho most elegant home la
tho city. There was roast chicken vegeta
bles of two varieties, celery and other con
comitants of a banquet, tho wholo topped
off with a Christmas pie. For two weeks
tho Shrlcers havo been busy getting the
nnmcs of tho deserving poor of tho city nod

Accident.
Edward Locke, one of th oldest nnd most
popular passenger conductors running Into
Omaha, was severely Injured yesterday
morning and as tho result of tho accident
had his left leg amputated at the knee.
Mr. Locke was In chargo of tho Missouri
Pacific passenger train which left Omaha
Sunday night enrouto for Kansas City.
At Union, whore tho train arrlTes nt 12:0j
midnight, considerable switching is neces
sary owing to tho cutting out of the Liu
coin coach. Ordinarily tho conductor fans
llttlo to do with tho switching, but yester
day morning Mr. IaicIco relieved his brake
man of somo of his duties and In doing so
suffered tho accident that proved so dls
nstroua. Tho tracks wcro slippery with snow nnd
whllo attempting to board tho train when
it was moving Mr. Locko missed his foot
ing und fell an tho rails, Tho train passed
over his body und so mangled the lower ex
tremities of his left leg that It had to
bo amputated, His right leg was also badly
crushed and a portion of tho foot had to
bo amputnted. Tho train wns held at Union
until tho surgeon's work was completed
and then Mr. Locko was taken to his homo
In Kansas City. Telegraphic reports re
ceived from Kansas City nro to tho effect
that Mr. Locko might bo unablo to recover
from tho sovcro shock, ns his condition now
Is somewhat critical.
