tions of tho caso In ndvanco they could not

tailed so llttlo risk of punishment.
What can they do with tho kidnapers If
they aro caught? Is tho question nsked on
ovory side. The answer Is that thoy will
probably como off very easily, because
theru Is no section of tho criminal codo
of Nebraska that Ills adequate penalty to
tho crime.
Thoro Is nn offenso known as "kidnap
ing" In our criminal statutes, which car
ries with It a penitentiary sentence, on
conviction, ranging from two to soven years,
but It applies only to kidnaping with tho
Intention of carrying tho victim outside
of tho state. Tho clause, which Is section
18 of thu criminal code, rends as follows:
Any person or persons who shall kldnnp
or forcibly or fraudulently carry olT or
decoy out of this statu an person or per
sons or shall arrest or Imprison any per
son or persons with tho Intention of having
such person or persons carried out of tint
state, unless It bo In pursuance- of tho laws
thereof, shall bo conllned In thu peniten
tiary not less than threo nor more than
hovpn years, and shall, moreover, bo liable
for tint costs of prosecution.
Manifestly It would bo Impossible to
provo that tho abductors of young Cudnhy
carried him out of tho state, bocnuso so
far as Is known they merely took him to n
point southwest of South Omaha, nnd if
they had any Intention of enrrylng him
out of tho stutn they did nothing to fur
nish tangible ovldenco of It.

Another penitentiary offeuso defined by
tho Nebraska criminal codo Is that of "child-
stealing," but this section, too, seems to
havo no application to tho present Instnnce,
because It refers only to stealing children
undor 10 years of age, while young Cudnhy
Is already 15. Tho wording of this section
of tho codo Is:
Every person who shall maliciously of
forcibly or fraudulently lead, take or carrv
-ii way, or decoy or entlco away, any child
under tho ago of 10 years with Intent un
lawfully to detain or conceal filch child
from Its parent or parents or guardlin. or
other person having tho lawful charge i f
such child, shall be Imprisoned In tho peni
tentiary not more than seven years nor
less than ono year.
Tho suggestion has been made that the
kidnapers might bo held on tho charge of
lovylug blackmail, Inasmuch ns they used
their possession of young Cudnhy ns n
means of oxtortlng money from his fattier,
but nothing In tho Nebraska stntutcs covers
this phase of It Tho crime of extortion, as
dellned In tho law, enn bo committed only
by public oraccrs, whllo It would bo dllllcult
to innko n complaint stick for obtaining
money under false pretenses, becauso tho
kidnapers mado no falso pretenses, but on
the contrary performed overy part of tho
promises thoy held out.
So far as can bo ascertained by tho police
In tho examination of tho law the only
chnrgo which can bo successfully brought
ngalnst thu perpetrators of this outrage Is
that of false Imprisonment, which Is not a
crime, but merely a ralsdemcunor, subject
to lino nnd Jail sontenco only. Tho statute
on false Imprisonment rends:
Kalso Imprisonment Is the unlawful viola
tion of the nersonal llbertv of another nnd
consists In conllnement or detention without
sulllcient legal authority. Any person con
victed of false Imprisonment shall bit lined
In any sum nut exceeding JM or Im
prisoned not exceeding o .o yenr la tho
county Jail.
Krom this it will bo seen that tho prob
lem what to do with tho kldnapors after
they aro caught is almost as much of a
puzzler ns the problem of fixing tho Identity
cf tho kidnapers, so that tho nmbltlous
aspirants for tho $25,000 reward offered
