At noon adjournment was taken until next
Thursday morning, on account of a part of
tho counsel having business beforo tno
supremo court at Lincoln. Tho attorneys
for tho contestants aro E. w. Slmoral ana
William A. Itcdlck, while Ed P. Smith,
Wllllnm Ourley and L. J. Plattl appear for
tho contcstocs.
Although the greater part of tho forenoon
was" consumed tn preliminaries Incident to
tho opening, enough material ovldanco was
brought out to Indicate that tho contestants
aro operating on a tangible basis and that
developments ot still greater moment aro
yot to come.
Clrrka Take Liberties.
Fred M. Youngs, ono of tho contestants,
was the principal witness of tho forenoon.
Mr. Youngs' testimony related particularly
to tho count In the First precinct of tho
Third ward In South Omaha. In substance,
Mr. Youngs said ho watched tho count In
tho aforesaid precinct nnd that bo saw
about two-thirds of it. Ho observed that
frequently when tho clerks could not
make their counts tally they simply agreed
upon whatever Ilguro was most favorable to
tho democrats or f unionists. Mr. Youngs
could not stato exactly tho number of votes

Mr. Youngs also raid he observed a strik
ing uniformity of ballots, that Is, as to tho
manner In which they wore marked. Ho
was questioned at length upon this point
nnd tho gist of his testimony was to tho
effect that many ot the ballots looked as It
they had been marked by ono man. His
reason for thus bellovlng, bo explained on
cross-examination, was that there wns a

served a few such Instances, but could not

All attempts of tho opposing counsol to
tangle Mr. Youngs on cross-examination
proved futile. Ho gave his tostlmony In a
straightforward, convincing manner, carry
ing tho conviction of truth.
County Clerk Hnvorly brought 'books
from his offlco and, as ono ot tho formal
Incidents required In the- proceedings, the
election figures wero produced as shown by
the records. The figures wero tho same
as havo already boen published In Tho
Bee, and their Introduction was simply ono
ot the legal formalities which enter into
tho hearing.
Other Candidates Testify.
A. J. Coleson and Carsten Rohwer wero
called to tho witness stand, but tholr tostl
mony was immaterial, tho idea being simply
to establish a record and lay tho proper
foundation for tho proceedings. They will
bo called, howovor, later in tho hearing, at
which time they will give additional testi
mony. Tho attorneys for tho contcstecs ob
jected to tho filing of the contest papers
as exhibits, on tho ground that they do
not contain facts sufOclont to bring tho
cases within tho Jurisdiction of tho legis
lature, which body must rnako final de
termination ot tho contests. It was agreed
by tho attorneys that all objections shall
bo recorded by the stenographers without
ruling from tho notaries, their power bolng
the satno as that of a notary in taking ordi
nary depositions. Mr. Schultz was the only
contestant who was not present. Numerous
witnesses will be examined and before tho
end is reached tho contest promises to bo
como spirited.
