anxious to havo the proposed Twenty-fourth
street vladnct constructed without delay. A
meeting was arranged for today, when tho
cc'inrntttoo will moot Mayor Moorcs and tho
city attorney and decldo what action shall
bo taken in the viaduct ruattor.
Persons who own land adjoining tho north
approach to the proposed viaduct at ono
tlmo agreed to walvo all damages providing
steel approaches be built. They failed to
sign tho waivers and now tho Improvement
club 1.1 nnxlous to havo tho city follow Its
original plan of permitting tho railroad to
grndo approaches to tho bridge.
Twenty-fourth street must bo widened to
mako room for dirt approaches and persons
owning adjoining property will seek dam
ages. Tho city, In Mr. Council's opinion, is
responsible for any damago clone. In case
tho Southwest Improvement club so ndvlses,
tho city ofllclnls will no doubt push an ordi
nance through for tho condemnation of this
ground nnd will order tho railroad company
to begin work at once. The delay has been
caused by a deslro on tho part of tho city
to avoid paying damaged, but this seems to
be impossible,

On November 14 J. Henry was taken with
tho dlscaso In an apartment house at 1823
Leavenworth street. Many people who
lived In tho houso hnd been exposed and
tha commissioner was afraid that other
cases would dovelop. Mrs. Henry waited
on her husband for several days before thn
caso was diagnosed. Sho was put undor
quarantine.
Tho houso was thoroughly fumigated, nil
tho persons who had been exposed wcro
vaccinated and every precnutlon was taken
to prevent tho communication of tho ills

J. J. Mullen has been sick with smallpox
at 2203 Burdctto street for moro than a
week. All of his family is quarantined in
tho samo houso with tho olck man and fto
fnr no member has shown any symptom of

C. H. Long, who was removed to the
omergency hospital last Sunday, had been
sick for noarly a week before tho caso was
brought to tho attention of the health au
thorities. His homo at C20 South Thir
teenth street was thoroughly disinfected.
Tho time for Infoctlon has passed and no
cases havo developed in that portion of tho
city.
Ucorgo Bauer and J. Robblns, who aro
now In tho emergency hospital, wcro taken
with smallpox while coming Into Omaha on
tho railroad. Both of tho men realized that
they had tho dlseaso and turned themselves
over to tho health authorities before expos
ing any Omnhans to tho dlscaso unneces
sarily. All of tho hospital patients had
very light cases of smallpox. Tho disease
has been kept so well In chock that tho
health authorities feel confident that thero
will bo no epidemic if people will tako steps
to fortify thomsclves against tt.
"Somo pcoplp seem to havo tho idea that
having been vaccinated when they wero
children they need havo no fear of small
pox," said Dr. Victor H. Coffman. "It has
been chown beyond tho shadow of a doubt
that vaccinations In childhood do not al
ways make lmmunes of adults. All grown
pcoplo in the city should bo vaccinated
again. It is better to bo on tho safo sldn
nnd every person in Omahn should hnvo
enough regard for public health to tako this
precaution."

session of Judgo Vlnsonhalcr's court to
amass a good deal of circumstantial evi
dence tending to show that the defendant
is guilty of tho charge preferred ugalimt
him conducting a gambling house. But
among tho dozon witnesses who told what
they know about Berlin and his vocation

gambling house supposed to bo his. '
Stockton Hcth, treasurer of the water
company, and W, D. Davis, manager of-tho
South Omahn Gas Supply company, Informed
thu court that tho bills for wntcr and gas
for tho building atr 2403 N street, South
Omaha, were paid In Berlin's namo, but they
wero unable to swear that Berlin was pro
prietor of the placo, Arthur Ncal,' a mo
chanlc, testified that ho had seen a sign
bearing Berlin's name hanging in front of
tho building in question, and that ho had
been in the gambling rooms on tho second
lloor of tho building on several occasions.
He had seen crap games in progress, also
faro tables and rouletto wheols with men
around them engaged In playing. Berlin he
had seen Bitting In a high chair nt one ot
I ho tables, but ho could not say that the
innn was tho proprietor. Charles W. Sum
ner, another mechanic, saw Berlin dealing
cards at one of tho tables on different oc
casions, but regarding tho proprietorship
he was not Informed. Walter Grler testi
fied that ho went Into tho gambling rooms
and erw various gambling games being
played. E. R. Cook substantiated the
statement, adding that a day later, when ho
went In company with Sheriff Power to ar
rest the gamblers and selro the parapher
nalia, the rooms wero empty and tho tahles
and equipment hidden in out of thn way
places undor piles of chairs. Berlin, he
said, seemed to have a proprietary Interest
in the furnishings of the room, as he was
anxious lest somo of the articles be broken
In removing them.

G. 11. Wheelock, who for several years has
been Internal revenue agent 1c chargo of
this Inspection district, has been assigned
to Now Orleans, taking charge of that dis
trict. Agent McCabe, who has been under
Captain Whoelock, has been asulgned to
San Francisco, and Agent Miles D. Ilouck
has been ordered to North Carolina to tes
tify In cnseB beforo the United States court
which he had worked up wbllo in that ter
ritory. It Is understood that ho will be as
signed to that district upon the completion
of the duties in court.
Dr. J, N. Garner has boen transferred
from New York to Omaha as agent In
charge. Dr. Garner was in Omaha a few
years ago us special gauger and has a host
of friends In the city who aro pleased to
see him roturn in a more important ca
