premo court Is expected to hand down de
cisions In thrco cafe of unusual Importance
ill Its next sitting, which begins Nuvomber
21. On one decision depends the future of
tho State Hoard of Transportation, on nn
nother tho collection of over 7D,000 of de
linquent taxes assessed ngnlnsl tho Lincoln
Traction company and thu third will prob
ably settle tho controversy over tho legality
of severnl provisions of the Nebraska anti
trust law. It wan seml-oluclnlly announced
Inst week that thu opinion In nil these
case had been written, but for some unex
plained rcatou they were withheld when
court adjourned.
Tho case Involving the anti-trust law Is
tho ono ponding against the Standard Oil
company, which Is before tho court on a
motion filed by tho attorney general for an
order nuthorlzlng him to Inspect and copy
tho private records of tho defendant. It Is
contended by tho attorneys for tho Standard
Oil company that this proceeding Is an at
tempt on the part of tho attornoy general
to ouforco a penalty or forfeiture for acts
declared by the ntatuto to bo n crlmo and
that tho allowunco of tho motion would be
an Invasion of the constitutional right of
tho defendant company to bo secure In Its
papers and effects against unreasonable
searches and seizures, and further that nn
order of tho nature asked for by tho at
torney goucrnl would be a violation of the
constitutional protection of the defendant
against being rompcl'ed In n criminal cac
to glvo evidence u'gnlnst Itself. These con
tentions are based on tho ground that the
act under which the case was Instituted Is
a penal statute, which makes a violation of
Its provisions n crime by specifically desig
nating such violation ns u misdemeanor.

Thero Is a misapprehension regarding the
filing of (orllflcatrs of election on the part
of members of tho Incoming legislature. A
number of tbeso aro laboring under tho Im
pression that tho certificates must bo filed
with tho Bocretary of state. Aa a matter of
fact tho law provides that they shall bo
lllod with thn clcrl; of each houso before the
opening of the legislature. It reads an fol
lows: The clerks or each house shall file the
cortltlcntes presented by members each for
his own house ami niaku ii roll or the mem
ber who thus appear to lie elected and tho
pcrsoim thus appearing to be elected mem
bers Khali proceed to elect such nllloers
aa may be required for thu time being.
Under tho law tho clerk of thu last bouse
and tho secretary of thu senate are officers
of tho legislature until their successors are
elected and qualified, and tho duty of
making out tho toll legally devolves upon
thorn and not upon tho secretary of stnto,
although tho practice for several years past
has been to allow the secretary to submit n
roll when tho two houses nssomble.

night tho following officers, who served dur

tary, J.. M. O'Neill: treasurer, L. I'. Sine;
vice president, II. II. Loughridgu. During

Slander Suit lit York.
YOIIK, Neb., Nov. 11. (Special.) What
bids fair to be onu of tho biggest, longest
and most bitterly contested lawsuit ever
tried In York county la In a caso whoro nn
action was brought by William I. llager
against William Otto for slander. Thorn
are twelve rounts claiming damago In each
In the sum of $2,500, aggregating a total
sum of 30,000. This Is supposed to be tho
outgrowth of a hog suit, wherein Hager
wiih one of tho witnesses whoso testimony
yas against Otto. W. I'. Uagcr lives near
Charleston nnd Is ono of York county's
most successful farmers. William Otto
lives near Charleston, owns an elevator
there nnd owns over 3,000 acres of land In
this county. Attorneys from outside of tho
county hnvo been employed to assist.

sing Swcdo songs. They marched to Pol
lard's cold storage warehouse, wbero Isaac
Pollard ordered unlimited quantities of sweet
rider served. After this Qus Davis and Hon
K. M. Pollard Ravo shoit addresses, when
tho crowd dispersed with cheers for Mc
Klnley. Roosevelt, the full dinner pall and
four years moro of prosperity.
Funeral if Jaiiim I. Million.
FREMONT, Nob.. Nov. 11. (Special.)
Tho funeral of tho late James P. Mallon
was held at 2 o'clock this afternoon from
tho family residence on F street and was
very largely attended, muny of his former
business and political atsoctates from this
county and from Omaha and Lincoln being
present. The services wero conducted by
Rev. W II Iluss of tho Congregational

In Lincoln this mornlug and has been busy
all day nt the Lludnll hotel receiving call
ers nnd listening to the appeals ot countless
ofllcescekcrs. He enmo from Fnlrbury, where
ho was the guest ot honor last night at a.
republican ratlHcatlon, and tomorrow he will
leave for cither Omaha or bis homo In Hast
ings. At ho depot ho was met by several
hundred members of tho Nebraska Traveling
Men's and Union Veterans' Republican clubs,
who escorted him to tho hotel.
"I havo made no promUes of appoint
ments," said Mr. Dietrich. "I havo told all
applicants to present their requests n writ
ing and I will not consider them unless they
aro in that form."
Mr. Dietrich said bo had.made no definite
plans for the future. Tho Union Veterans'
Republican r.lub will meet tomorrow night
to arrange for a ratification to tako place
somo time this week. Mr. Dietrich nnd sev
eral of tho stato officers-elect will be at tho
ratification.
