Them tho Usual Appropriation.

The Douglas County I'alr association Is In
a very good humor over a decision rendered
by Judge Koysor yesterday and promises
to glvo an exhibition this fall of stock, fruit
and grain on an Olympian scale. It will be
tho first regularly conducted county fair for
thrco years nnd It was largely on this ac
count that tho county commissioners refused
n few days ago to grant the appropriation
usual In former years. The court has in
iitructod tho commissioners to yield up the
usual amount, however, and tho fair asso
ciation will have $2,771.10 with which to
start their show.
Commissioner Hoctor took tho stand to
prove that tho fair association has not pre
viously lived up to Its contract. It Is speci
fied In the statute that tho association must
glvo an annual fair in which stock, vegeta
ble and grain products shall make up the
display and thero aro speculations as to Its
elzc, etc. In 1S08 the association Incor
porated Its exhibit with the Transmlsslsslppl
exposition and no funds were appropriated
by the commissioners. One year later, how
ever, the county board granted tho associa
tion a two years' nllowance In one, although
live stock hnd no part In the association's
display. Commissioner Ostrom testified to
the same effect, bringing out tho alleged
fact that the association had held no indi
vidual fair and had exhibited no live stock.
President Oscar l'lckard of the fair asso
ciation testified that tho only reason live
stock was not included In tho exhibit wns
that thero was no room for pens or stalls.
Tho spirit of the statute, he said, had been
lived up to during ench of tho last three
years.
Judge Keysor was guided In his decision
by tho statute which provides that n county
fair association shall bo granted 3 cents per
capltn In the county with which to carry on
Its exhibition. The association was shown
to bo legally orpanlzcd and entitled to the
benefit nxed by Btotutc. Tho mandamus
was thercforo granted.

' Andrew E. Walkup, nn nttorney, who,
ilurlng the last fow weeks, has been giving
his attention to police court practice, was
nrrcstcd Wednesday morning and lodged In
jail, charged with larceny as bailee.
Tho complaining witness Is a negress.
Mrs. Knto Harris. Two weeks ago, sho
says, she gave Walkup $12 to bo used In
getting her husband, Henry Harris, out cf
Jail. Sho sayB he agreed to accomplish
this by noon of tho following dny, but
failed to do so and, so far as Bho Is able
to seo, did nothing whatever In tho matter,
leaving Harris to sorvo out his term.
Meanwhile sho is out tho $12.
Walkup was arraigned In pollco court
during the afternoon, pleaded not guilty
nnd was released under bond to nppenr
for trial August 29.

Tho letting of the contract for the con
struction of the new Calvary Baptist church
has been postponed until August 30, at
which time bids will be opened hy J. V Car
penter of the board of trustees. The new
building is to be ono of the finest of Omaha's
suburban churches. It will cost $25,000 and
will be complete In every detail. The plans
contemplate a brick and stone structure 113
by 88 feet, the outside walls to bo of pressed
brick nnd all other walls to bo of the best
quality of hard burned brick. The building
will consist of a lecture r.oom, auditorium,
class rooms, parlor and study, and In the
basement n kitchen nnd dining room. The
site Is at the southwest corner of Twenty
fifth and Hamilton streets. Tho trustees
hope to have tho edifice completed by March
1, 1901.
lie v. Thomas Anderson, pastor of the
Calvary church, Is now In Scotland, where
ho has spent his three months' vacation.
He will return to the city tho first week In
September.

James Otto appeared In tho office of tho
Midland hotel at 3 o'clock Tuesday after
noon with n gunshot wound In his bend and
Informed tho clerk that ho had accidentally
discharged a revolver and that tho bullet
had lodged In his skull. He was taken to
tho Presbyterian hospital at once, where
the bullet was removed and pieces of tho
fractured skull taken from tho wound. Ho
Is resting easily nud tho surgeons believe
that ho will suffer no great discomfort
from the accident.
Otto Is 22 years old and came to Omnha
from Sidney, In., Inst Monday In company
with his brother. Ho placed himself un
der tho enro of somp mnsnnttc healers, who
were treating htm lor chronic stomach
trouble. Monday nnd Tuesday he com
plained that his room at the Midland ho
tel wus very hot, but there was nothing
unusual about his actions nnd tho hotel
peoplo are inclined to believe the story
that tho revolver was dlscharccd acci
dentally. Tho bullet entered the skull In
such a manner, however, thnt tho
physicians think tho weapon must have
been held nt a right angle to tho skull and
nro nt a loss to explain how tho weapon
could have been In this position If acci
dentally discharged.
Tho revolver was of 22-callber nnd tho
bullet entered the skull just novo the right
car. It mado an ugly wound in the scalp
and penetrated both layers of the skull bone,
splintering tho Inner layer of bono In such
a manner that many pieces of bono bad to
bo removed to relievo tho brnln.
Otto told tho samo story to tho hotel clerk,
tho surgeons nnd hospital peoplo and stoutly
maintains that the shooting was accidental
and not with suicidal Intent. He lives with
his parents on a farm near Sidney and has
tho appearance of an ordinary farmer's son.
Otto's brother returned to Sidney Mondny
evening and none of his relatives Is with
him at present. Thero wcro no guests In
tho rooms adjoining that of Otte when the
Bhootlng occurred. Tho hotel peoplo did not
hear tho report of the revolver nnd knew
nothing of tho accident until Otto made his
Injury known.
