The motor company Is preparing to rpave
that portion of Hroalviay between the wa'er
works reservoir and the 6oden approach
to Its brld;e over the Missouri with granite
blo'ks. Plfty rarloads of granlto blocks
are now on their way here and as soon as
they arrive work will at once be commenced
on the paving. Tills portion of Ilro&dway Is
on private ground, the property of the mo
tor fornpany, and was formerly paved with
cedar blocks. When they wore out the
meet was kept In passable condition with
cinders.
The company has commenced the work
of taking up the tracks laid by the Huburban
company on Avenue C, and the rails will be
used to replaco the old ones on the Omaha
line. The work of replacing the old rails
with the heavy Hteel from the Huburban
tracks will be commence! at Jflnth street,
Omaha, across the bridge, and then east on
Avenue A. Jt Is the Intention of the Motor
company to replaco the rails on Its entire
system with heavier steel.
The rontract for removing a portion of
the dirt from the entrance to Kalrmount
park ha been let by the motor company
to K. A. Wlckharn and work will ho com
menced on hauling tho earth away tomorrow
morning. A compromise ha been reached
between the motor company and the park
commissioners and tho public will soon be
able to reach the park without having to
cllrnb over tbn mais of dirt now filling
the cut entrance. Under the terms of the
compromise tho motor company Is to remove
sufficient dirt 011 tho east side of the en
trance to gel at Its tracks, now burled sev
eral feet deep, tho park commissioners to
remove tho remainder, or as much of It as
cannot be graded down to make an easy
driveway Into tho park. The motor company
Is to protect tho east elilo of the cut and
tho park comrnlHSloners tho west. As soon
as possible tho motor company will run cars
direct Into the park.

mined to keep up the fight against Caterer
Balduff at Manawa park, aad yesterday
served notice on the management of the
motor line that application would be made
to the district court for a temporary writ
of Injunction restraining the sale of liquor
at the lake The papers, It ts understood,
have been drawn up and the Injunction Is
against tthe Omafc. Council Bluffs & Hu
burban Hallway company, the Omaha U
Council Bluffs Railway and Bridge company

Balduff, the proprietor of the cafe at Man-1
awa park, not belnr Included in the tut

rected against him personally. The papers
were not prepared In time to serve yester

tlement of the controversy, but the de
mands of the union are such that Mr.
Balduff states he has no alternative but
to refuse to entertain them. Tho union
Inslsla In the first place that Mr. Balduff
discharge his manager at the Manawa cafe,
Thomas I'urshome, and that the union be
permitted to appoint the head waiter In
the second place It demands that the wait
ers employed at the cafe bo directly under
the charge and control of this head waiter
and that Balduff have nothing to say to
them except through the head waiter.

Peterson against the Hoard of Education
to restrain It from selecting or paying for

the new High school was revived yesterday
by a motion filed on behalf of the plaintiff
to amend tho record as to the dismissal.
Hlack I'etorson some months ago filed a
dismissal of tho suit and he now asks lhat
the record be amended so as to Hhow that
tho dismissal -a as filed only so far as he was
concerned and not on account of tho other
persons Intorostod In the suit with him.
This motion Im made to protect the sure
ties on Iho Injuni'tlon bond and to keep the
caso In court and to allow a determination
of the question of costs and attorney fees.

openly advocated the changing of the lo-a
tlon of the drays from their present piare

said, was just as good a location for them

Killed hr Cars.
George Young, a trusted employe of the 1
Western Weighing association, was yester-1
day struck and Instantly killed by a freight 1
train near Armour & Co 's plant. Young 1

which place he la Inspector In the employ
of the association, when killed. No accurate
account of the accident seems to b obtain
able. Both of his feet were,severed and
his right arm crushed
He was about 40 years old and leavei a
wife and four children residing In Albright.
No arrangements have as yet been made as
to the funeral and will not be made until
bis parents, who reside In the east, can be
heard from. An Inquest will be held Mon
day morning at 0 o'clock In Brewer's un
dertaking rooms, at which place the re
mains are lying.

While passing In front of the saloon of
Clarke & Wayne, Twenty-sixth and P
streets, Officer Robinson heard sounds com
ing through the open door that could lead
him to but one belief, and that was that a
mammoth crap game was In progrc-s. He
hastily summoned help from the station and
throe other olflccrs were sent to his assist
ance. When tho saloon had been surrounded
Officer Robinson entered and found a game
tbat could hardly be called enthusiastic; It
was oven worse than that. Sixteen negroes
wore perched upon two blllard tables and at
tho top of tholr voices were beseeching
providence to "turn do bones" In the man
ner they desired. They were all brought to
tho station. Including tho proprietors of the
saloon, and locked up. m
