MR. HERRING MAKES AN ADMISSION

1JipiiiI More 'I'll nn .Mini Voted
nml t'lnlniH It Hint it
Itlulit to Do So,
Tho injunction suit to restrain tho Board
of Kducntlon from erecting a High school In
excess of $150,000, cost price, was submitted
ycaterday, following a rather dramatic
appeal for tho board by Attorney Carl Her
ring. Judgo Keysor remarked that ho np-
predated tho need of hasto In deciding tho
C(l96 am, wou,(, nnnounce hi3 opinion early
next week. Ho added that Inasmuch ns the
board members were known to havo tho best
Interests of tho community nt heart ho
would not wish to say without duo tlmo for
consideration that they had exceeded tho
law.
In tho concluding speech Mr. Herring
frankly admitted that It was tho board's in
tention to exceed tho 1150,000 limit fixed
ns the maximum in the bond issue. "Tho
present Hoard of Education," said Mr. Her
ring, "Is mado up of men who have sacri
ficed their business Interests to servo tho
city's welfare, and they havo done It he
roically. If the board is n set of knaves
and Imbeciles, Ood help tho taxpayers who
put them there; tho people havo put theso
men In office nnd they must trust them.
On my advice ns official attorney tho
board has entered upon tho construction of a
building which I believe will cost $163,398,
exclusive of architect's fees. I havo udvlscd
tho board that It has tho power to spend
$25,000 annually In increasing school facili
ties In accordance with a charter provision.
The taxpayers havo voluntarily separated
themselves from this sum nnd havo left
entirely at tho discretion of tho board what
shall bo dono with It. I hold, therefore
that It is no concern of tho people, and, 1
say it with all respect, it is no business of
this court what disposition is mado of tho
money."
"Then, for example," interrupted Judgo
Keysor, "If tho people should express a de
sire for a $30,000 school building at Twen
tieth nnd Hnrncy streets do you think tho
board could say, 'We will increase tho cost
to $55,000?' "
"I say frankly that I believe tho board
could," answered the attorney.
W. S. Poppleton explained that ho had no
Intention of calling any hoard member cither
a knave or nn Imbecile, but believed, on tho
contrary, that each ono was actuated by a
high Idea of duty. "If they havo made n
mistake, as I believe, however," said Mr.
roppleton, "and havo exceeded tho law, I'm
sure they wish to bo set right as much as
anyone."
Court Motes.
The testimony Is concluded in tho case
wherein Mayor Moores and others went on
