day a letter from McArthur liros. com
pany , a Chicago llrni of contractors , dated
nt Lebanon , Tcnn. , stating that their fore
man , Hobcrt West , had been drowned while
crossing the Cumberland river in a canoe at
Carthage , Tenn. The letter states that
West's homo was thought to be In Council
DlnlTfl and that ho was acquainted with cx-
Postinastor Thomas Uowman. West , the let
ter continued , was about -10 yrnra of age and
"ormerly drove a team for McArthur Hros.
in the Chicago drainage canal. He had been
working for the firm at Lebanon , Tenn. , for
ibout three years and was believed to have
been In Council Bluffs In 18SO. The body
it the time the letter was written had not
been recovered. West , the letter says , was

The district court grand Jury , which had
completed Its work Tuesday aftrnoon , mada
Its Html report to Judge Smith yesterday
morning , in the absence of Judge Thornell ,
and was discharged lor the term. A number
of Indictments we're returned , but only ono
of them was made public , the others being
withheld , as the defendants were not in
custody.
The indictment made public was against
Ell IJrown , the Uroadway grocer , on the
charge of uelllng and having In hi. ) posses
sion for aale oleomargarine containing col
oring matter In Imitation of butter , in viola
tion of the Iowa laws. The Indictment la
the result of prosecutions Instituted against
Hrowti and other dealers in this- city by
the state dairy commissioner and hU dep
uty. The others pleaded guilty nnd paid
flnos , but Urown took the otam ! that the
law waa unconstitutional and decided to
light the case , taking It to the supreme
court If necessary. Ilrown at once gave
ball for bis appearance.
Although the Indictments were not made
public , It was admitted In the couuty nt-
torney'H ofllce that the grand Jury had found
"truo bills" against S. J. James of South
Omaha , the "divine healer , " and Mrs. P. 11.
Yatca of Tabor , la. , on the charge of being
criminally responsible for the death of the
latter'a daughter , Ethel Yates , which oc
curred In this city January f > .
) The grand jury made the following report
on the city jail : "Wo have examine , ! the
city jail nt Council Bluffs nnd nnd that It
is not kept clean ; that It Is not properly
ventilated , and the prisoners confined there
are not sufficiently supplied with bedding.
A number of prisoners were confined In the
city Jail at the time of our visit , on Jan
uary 12 , 1900. "
Judge Smith Instructed the clerk of the
district court to call the attention of the
city authorities to the report of tlie grand
jury.
The report of the grand jury on the county
jail ehowed that It was In good condition.
_ The grand jury In the case of Justice Vlen
decided that there was no criminal Intent
on his part In withholding certain fees from
the county which ho claims are duo him for
ofllco rent and expenses , and County At
torney Kllpack will bring suit to rcco\-cr
the amount. This is exactly what Justice
Vlen desired , as the question can then bo
settled by the courts on an agreed tate-
ment of facts. In the event of the court
ruling against him , Justice Vlon Is at once
prepared to turn over the 1190 to the county
treasurer.
Judge Smith granted Mrs. Jennie Wlen-
berger a divorce from Joseph W. Wlen-
berger on the grounds of desertion.
Judge Smith will preside until Judge
Thornell returns from Atlantic , where he
was called In connection with matters re
lating to the defunct Cass County bank.

The supreme court of this state handed
down Tuesday two decisions which are of
vital Importance to this city. Ono was the
ruling In the Dea Molnes municipal electric
lighting plant case , nnd the other the de
cision In the Cedar Rapids municipal bond
caEe. Hoth are of peculiar Interest to the
people of Council Bluffs , as the city had
recently been contemplating letting a con-
tiact for a miinlclp.il lighting plant and be
cause the Cedar Rapids bond case bears di
rectly upon the issue of bonds recently
authorized by the city council to take up
tin ) outstanding general and water fund war
rants for the purpose ) of placing the city
or. a cash basis.
In the first case the supreme court holds
that a city practically cannot enter Into a
contract for the erection of a municipal
plant which Imposes on the city liabilities
In excess of the constitutional limit of
debt. In the case at bar the contract pro
vided Unit the plant should bo paid for In
Inrtallmcnts , ami at the conclusion of the
term covornl by the payments the plant
should become the city's'property. . This
was the B.-imo proposition that Alderman
Cns-por tried to Involve thin city In. The
ruling of the supreme court Is conceded to
deal a black cyo to all attempts of cities In
this state to obtain miiniclp.il ownership of
public utilities : The court In Its ruling salil ,
In part :
"II Is generally held that future revenues
may bo anticipated to meet contracts for
current expenses , but there Is radical dis
tinction between a contract to procure light
for a city and a contract for the construc
tion of an electric light plant , and the no-
ccbtlty for the plant would constitute no ex-
ciisti for the violation of the constitution.
\Vhero the contract Is for the erection of an
improvement nnd the tlmo of payment Is
postponed to Inter date nnd no special levy
is authorized to pay for the Improvement ,
then the rule Is well settled that the sums
to become duo In tlio futurn must bo taken
into account In estimating the existing debt.
AH a general rule a city may not anticipate
Its general revenue to be creatfd by a scheme
of general taxation. The legislative Intent
liar been to pluco the city on a cash basis
ami prvvent the accumulation of a IkutIns
Indc-btedncES. H Is said on behalf of the
city that it did not obligate itself to pay
more under the contract for the plant than
It had heretofore been paying for lighting.
Surh situation , however , does not authorize
tht > city to enter Into a contract for the con-
stiuctlon of n plant In violation of the con
stitutional limitation. The provision that
the city should rebuild the plant In case of
< ' ( r.trncton ! by fire or otherwise could not bo
enforcid If when tlmo for performance nr-
rived the city was Indebted to the consti
tutional limit. "
The proposition made by E. L. Draffcn nnd
the othpr Chicago bidders to erect an elcc-
trln lighting plant In this city to bo owned
lu the future by the municipality was on
the same bails as tbo Dea Molnes contract
called for.
The decision In the Cedar Haplcle "bond
case Is favorable to the Issue of the bonds
recently authorized by the city council.
Judge Dillon ot New York , to whom the val
idity of the- bonds was referred , has been
holding bis opinion back until the Cedar
Iluplds caeo was derided. Wallu the case
there and the proposed Issue here ore not
exactly analogous , etlll many of the tame
points are Involved In bolh. The $200,000
i IfFiie authorized by the city council was
proposed to take up the old outstanding
Ktnirnl and writer fund warrants and thus
place thu city on a cash basis. Ono of the

i of the city to exceed the constitutional limiter
or whether tlipy would simply tnko the

anticipate a favorable derision from Judge

The Hoard of County Supervisors at Its
session Wednesday afternoon took another
turn at the matter of Sheriff Cousins' depu
ties and , despite the fact that Judge Thor
nell had appointed Harry nrown nnd Fred
Peterson permanentbalHITa of the district
court , adopted the following resolution :
Resolved , by the board , Tlmt In constru
ing the resolution of ilnto of January 11 ,
HUM , the Intention IB that the entire ex
pense to accrue to the county'ln the matter
of employment of bailiffs to the district
court nnd grand Jury at Council Hluffs , In
addition to the salaries to lie paid deputy
sheriffs , shall be 12 n day for ono bailiff for
each , the said district court and grand Jury ,
the latter to be paid for services only dur
ing the sessions of that body. Additional
bailiffs required to lie supplied from the
force of deputy sheriffs. The sheriff hav
ing designated to this board tlio names of
such bailiffs , to-wlt : Hairy M. Brown , dis
trict court bailiff , and Fred Peterson , bail
iff for the grand Jury , In agreement with
this board. It Is further ordered that the
payment of salaries to bailiffs as herein
directed relates to these two persons.
This action of the board practically Ig
nores the order of Judge Thornell , n certified
copy of which was Illed with the supervisor1.
Judge Thornell's order was as follows :

It Is ordered by the court that the sheriff
be allowed the assistance of two perma
nent bailiffs , the same to be appointed by
him to serve both when the grand Jury Is
In session nnd at other times , nnd there
upon the sheriff appoints Harry Urown nnd
Fred Peterson to net as such bailiffs and
the appointment of said ballllTs Is con-
Ilrmed liy the court.
The board confirmed the appointments of
II. B. Crofts and A. Johnson ns deputy sher
iffs nt Avoca , but the- only remuneration
they will receive will bo T2 a day when act
ing as ballllTs ot the district court > and
grand jury there.
The bonds of the banks In which the
county's money Is deposited were referred
back to County Treasurer Arnd for the
sureties to qualify under oath.
The following resolution on the death of
Simon Wright was adopted :
Whereas , Information of the death of
Simon Wright at his homo In Wright town
ship comes to this board ; nnd ,
Whereas , Mr. Wright served faithfully
and well as a member of this board during
the early years of the history of this
county ; therefore , be It
Resolved , That the Hoard of Supervisors

LEMAHS , la. , Jan. 17. ( Special. ) The
Plymouth County Hoard of Supervisors has
just decided that newspaper exchanges are
subscribers. Olllclal proceedings of the
board must bo ' published In three county
papers of the' largest circulation. Four
publications competed. ' The light for the
third plum was between the Merrill Record
and the Klngi-loy News. The Record filed
an affidavit that It had C21 subscribers.
The News filed 623 names. The News then
objected to the Record's list , on the ground
that exchanges were Included among the
n I'm her.
The attorney for the Record took the
ground that the object of the law was to
give the greatest publicity to the olDclal
proceedings and that the exchange Is the
best possible medium for that purpose. He
argued that an exchange * was n subscriber
Inasmuch as a consideration was given for
it and the board took this view of It.
