Kennard necured a Judgment In the district court of Kancastcr county two yearn ago , but In the supreme court the de cision was roveroed nnd remanded for an other trial. The next finding of the court was In favor of the state and ngalnst Ken nard. This decision wa.s affirmed today. Mr , Koxworthy died two years ago , but the Judgment falls to J. H. Web- eter , administrator of his estate , who has an assignment of the cauro of action for legal services rendered. Koxworthy attacked the validity of n law on the ground that the legislature could not amend the title of an ni I that had been passed at a previous ses- plnn without reciting the whole law. ( Special. ) Judge Stull has made a ruling In the case Involving the constitutionality of the free attendance high school law , holding that the law Is good. The action was taken on a demurrer tiled to the appeal from the decision cf the county commissioners of Ne- maha county , who rejected n claim for tu ition enndc hy the Auburn school district. The case was argued January 2 by M. R. Mclnlnch of Auburn on the part of the school dlslrict nnd County Attorney Kcr- ncau for the county. The court ruled that Iho law provided for a tax that was equal and uniform throughout the district to be taxed and within the constitutional provi sions for taxation. ( Special. ) Judge Moore of the Klghth judicial circuit las rendered an important decision In ro- ard to the wolf bounty law of this state. The case was the Mead County bank against he Auditor of South Dakota. The bank purchased a number of wolf nnd coyote cer- IHcates from parties prior to July 1 , 1S99. When the b-.ak presented the certificates of purchose to the state auditor they were refused payment and the matter was brought nto ccurt by the bank. Judge Moore held that since ; the act which appropriated $5,000 from the general fund for this purpose made the amount payable for the year 1899 and each fiscal year thereafter , the state was In duty bound to pay the claim of the bank.
