An act to establish a law iinlfoim with
the laws of other stntca relative to divorce
procedure and divorce frccn the bond of
marriage.
Bo It enacted , etc. :
Section 1. No divorce shall bo granted for
any cause arising prior to the roslnc'iice of
the petitioner or defendant in this state ,
which was not a ground for divorce lu the
elntu where the canto arose.
Sec. " . No person bhnll bo entitled to a
divorce for any cause arising in this state
who has mot had actual residence In this
ctnto for nt least one > eir next before
blinking suit for a divorce with a bona Ildo
Intention of making this state his or her
permanent home.
Sec. .1 No pel son phnll bo entitled tb a
divorce for any cause arls ng out of this
etato unless the pctltle-er rr defendant
shall have resided within this state for at
least two jcars next before bringing suit
for divorce , vslth n bona Ildo Intcntljn of
making this state hlo or her pormtncnt
home.
Sec. 4. No person shall be cntltLd to a
divorce unless the defendant .shall hfivo
been personally served with pr-ceaj , If
without this state , or with persannl notlcj
duly authenticated , if out of this fcta'e , or
unless the defendant eliill have uittred
an appearance In the ease ; but If It
shall appear to the satisfaction of ) thg
couit that the petitioner does not know
the address nor the residence of the defendant -
fondant , aiid has not been able to ascertain
either , after reasonable and due Inquiry
and search continued for one > ear , the court
or Judge in vacation may authorize notice
by publication of the j.cndmcy of the pe
tition for divorce to bo Klven in manner
provided by law.

Sec. 5. No divorce shall be granted solely
upon default , nor solely upon admissions
by the pleadings , nor except upon trial before -
fore Iho court In open session.
Sec. C. After divorce either | arty mny
marry again , but In cases where notlcfs
have been given by publication only , nnd the
defendant has not appeared , no decree for
divorce ehall become Ilnnl or operative un
til six months after trial and decision.
Sec. 7 , Wherever the won ! "divorce" oc
curs in this act it blmll be deemed to nean
divorce from the bond of marriage.
