AA'llson of the Internal revenue bureau has
decided that when banks loan money with
out taking promissory notes and specified
collaterals are pledged as security for a
certain and definite sum of money , as evi
denced by entries on the bank's loan books ,
etc. , a tax accrues as a pledge. The ques
tion came up on a case in Philadelphia.
AVhen a specific loan Is desired , the bor
rower cither signs an application for a leaner
or makes a verbal request for a loan , at
the same time submitting collaterals which
ho desires to pledge as security for the
loan. Upon approval by the proper official
of the bank , to whom the borrower has
applied for a loan , the paying teller cither
gives the borrower a cashier's check for the
amount of the loan or the borrower's ac
count is credited with the amount of the
loan. The collaterals which the borrower
has pledged are placed In on envelope , on
the outside of which said collaterals are
listed. The loan In detail Is entered on
the loan book of the bank and such other
entries are made on th'e books as are neces
sary. This , It Is stated , is the general
method pursued by the hanks In Philadel
phia , as well as by the banks In New York
and elsewhere.
In some Instances no application for a
loan Is signed , nnd the collaterals are not
listed on the outside of tbo envelope In
which they are placed , but In all cases the
collaterals pledged for any loan are either
listed In detail on the outside of the en
velope In which they are placed or on the
loan book of tbo bank making tbo loan ,
but In no instance 'is a promissory note
used.
In a letter to the revenue agent at Phila
delphia , Commissioner Wilson sayn :
"You are ndvlacd that In determining
whether there arc any taxable features in the
manner of ranking loans as herein de
scribed the 'continuing aRreement' should
not ho considered , as it docs not refer to
any single transaction between the bank
nnd the borrower , but merely defines the
relative rights of the hank and the bor
rower. It Is not a pledge and In , there
fore , not subject to taxation as such , noi
docs It embody a power of attorney.
"Under the paragraph of schedule. A be
ginning with the words 'mortgage or pledge'
a tax Is Imposed on any pledge of personal
property where same shall bo made as a
security for the payment of any definite
and certain sum of money lent at the time ,
and this office holds that when certain col
laterals , as evidence by the endorsement
on envelopes hereinbefore referred to , nr
by the entries on the loan hoolc of the bank ,
or both , are pledged by the borrower to e-
curn any definite gum of money , this pledRO
la subject to taxation under the paragraph
of schedule A above referred to , nt the
rate of 25 cents for each $500 or fraction
thereof In exceen of $1,000 of the amount
secured. "

Saturday afternoon from the Kanwaa and
Texas mines , Just weat of town , determined
to avenge a beating administered by union
miners to nonunion men earlier In the
day. They were all heavily armed and
began shooting In all directions aa they came
Into town. Several persons had narrow
escapes , the clothing of two cltlzena being
pierced by hullcts.
Sheriff ( llcnn and deputies arrived In
Bevlcr late In the afternoon and , with the
aid of the Kansas and Texas mine officials ,
got the mob of Infuriated miners back to
their quarters at th mlne . The towns
people generally armed themselves and wore
prepared to ropul o any direct attack , but
did not lire upon the rioters.
