Commissioner Wilson of the Internal revenue bureau has decided that when banks loan money with out taking promissory notes and specified collaterals are pledged as security for a certain and definite sum of money , as evi denced by entries on the hank's loan boakf * , etc. , a tax Accrues as a pledge. The ques tion came up on a case In Philadelphia. When a specific loan Is desired , the bor rower either signs an application for a leaner or makes a verbal request for a loan , nt the same time submitting collaterals which ho desires to pledge ae security for the loan. Upon approval by the proper official of the hank , to whom the borrower has applied for a loan , the paying teller either gives the borrower a cashier's check for the amount of the loan or the borrower's ac count Is credited with the amount of the loan. The collaterals which the borrower has pledged nro placed In an envelope , on the outside of which said collaterals are listed. Tbo loan In detail Is entered on the loan boolc of the hank and such other entries are made on th'o books aa are necca- sary. This , It Is stated , Is the general method pursued by the banks In Philadel phia , as well as toy the banks In New York and elsewhere. In some Instances no application for a loan Is signed , nnd the collaterals are not listed on the outside of the envelope In which they are placed , but In all cases tha collaterals pledged for any loan are either listed In detail on the outside of the en velope In which they are placed or on the loan book of the bank making the loan , hut In no Instance 'is a promissory note used. In a letter to the revenue agent at Phila delphia , Commissioner Wilson saye ; "You are advised that In determining whether there are any taxable features In the manner of making loans as herein de scribed the 'continuing agreement' should not bo considered , as It does not refer to any single transaction between the bank and the borrower , but merely defines the relative rights of the bank and the bor rower. It Is not a pledge and lo , there fore , not subject to taxation as such , nor does It embody a power of attorney. "Under the paragraph of schedule. A be ginning with the words 'morlgage or pledge' a tax IB Imposed on any pledge of personal property where same shall bo made as a security for the payment of any definite and certain sum of money lent at the time , nnd this office holds that when certain col laterals , aa evidence by the endorsement on envelopes hereinbefore referred to , or by the entries on the loan boolc of the bank , or both , are pledged by the borrower to He- cure any definite sum of money , this pledge Is subject to taxation under the paragraph of schedule A above referred to , nt the rate of 2.r cents for each $500 or fraction thereof In excess of Jl.OOO of the amount secured.
