resenting Walter R. Kern of Philadelphia
and other holders of the perferred stock of
the Federal Steel company appeared before
Vice Chancellor Reed In the court of chanc-
eiy here this afternoon nnd asked for an In
junction restraining the company from payIng -
Ing the l'/i per cent quarterly dividend re
cently decfared on the common stock. Mr.
Kern's hill says holders of $46,000,000 of the
preferred sto-'k Join with him In the Issue.
The claim Is made that even If a dividend
has been earned en the common stock , It
cannot , under the companj's charter , be paid
until January , 1900 , out of the surplus net
earnings of the year. The company at ths
tame time declared the usual dividend at
the rate of C per cent on the preferred stock
and the plaintiffs allege that the payment ot
adlvldend on the ommcn stock at this time
will Jeopardize their Interests.
Vice Chancellor Rted granted a prelimin
ary restraining order until July 3 , when the
matter wilf be argued.
