Business Men Opposed to Compromise with
Union Pacific Company.
FIFTH AVENUE BRIDGE MATTER TAKEN UP
IJrnc the Clly Coun
cil to TnUe Action to Annul
Comiinny'fi Frnnchlnc oit
Union Avenue.
The business men of the city demon
strated last night at the mooting of the
city council , sitting as a committee of the
whole , that they iwcro opposed to the city
making any compromise with the
Union Pacific in the matter of
the controversy over the Fifth avenue
bridge. Further , the business men
through a committee , representing all
classes of ibuslncfa , urged the city council
to protect the Interests of the pity Iby taking
action looking toward the annulment of the
franchise granted to the Union Pacific for a
right of way on Union nvenue.
The committee , through Dr , J. M. Dar-
etow , presented n statement In which It
was shown how the railway company had
failed to aWde 'by ' the terms of the ordi
nance granting It the franchise on Union
avenu * and the following resolution :
Resolved , by the city council of the city
of Council Bluffs , Iowa , That the ordinance
franchise and grant heretofore granted to
the Union Pacific Hallway company for oc
cupation of Union avenue , approved Juno
30 , 1SSO , entitled "An ordinance granting
right of way to the Union Pacific Railway
company on certain streets , " Is hereby re
scinded , canceled and annulled by reason
of the non-compllanco of the Union Pa
cific Hallway company with the provisions
therein stated , and that all rights , privi
leges nnd Immunities running to Bald Union
Pacific Railway company , Its successors nnd
assigns thereunder , are hereby canceled ,
annulled nnd withdrawn , nnd the city of
Counclr Bluffs , through Its city council ,
hereby declares all rights , privileges nnd
Immunities therein granted to said railway
company , Its successors and assigns for
feited and at an end.
Addresses In support of the city taking
action looking toward annullng the Union
Pacific's franchise on the avenue were made
by Dr. Barstow , E. H. Morrlam , Frank
Keys , H. A. Searle , I. N. Fllcktnger nnd
Emmet Tinley. George F. Wright appeared
for the railway company and in n review
of the history of the franchise and mat
ters in connection with It said H was a
matter that would have to bo determined
by the courts.
The keynote of the several addresses
made toy the members of the business men's
committee was that the city should stop tem
porizing with the railway company , as by
so doing It prejudiced the1 rights of the
city and acted as an estoppel against It
over taking action to recover Union avenue ,
which It was claimed had been forfeited
by the Union Pacific .by reason of It not
living up to the terms of the ordinance
granting It the franchise. The discussion
lasted several hours and the commltteo ad
journed without taking any action. The reso
lution presented by the business men will
bo brought up at the meeting of the city
council Monday night.
The committee of business men present
composed the following : E. H. Merriam , F.
