The employes of the motor company have
presented F. C. Clark , the retiring cashier ,
with n handsome opal and diamond pin. The
presentation was made by I. Lovett , chief
electrician. The delegation , numbering about
twenty , representing all branches of the
service , were treated to refreshments by Mr.
nnd Mrs. Clark at'their home on South First
street. Mr. Clark leaves the motor company
to take a responsible position with the

The litigation In the district court over the
will of the late Mrs. Sarah J. Hnllard took an
unexpected turn yesterday. The hclrs-at-law
who had commenced suit to have the will set
aside withdraw their objections and on the
proper showing being made the will was ad
mitted to probate. They also flle < l their con
sent to the appointment of N. M. Pusey as
executor. This ends nil the litigation so far
ns the will Itself Is concerned , but does not
affect tfco suit brought by the heirs against
the Woman's Christian association to have
the bequests made to the association by ilrs.
Bollard during her lifetime set aside.
Mrs. BaTJard by her will left all of her
property , with the exception of the bequest
to Uio Woman's Christian Association hos
pital , to bo divided "share and share alike"
among her grandchildren , the children of
her daughter , Mrs. Virginia Robinson , and of
her son , O. H. Ballard , A clause In the will
provided that In the event of any of the heirs
having made an attempted sale or assign
ment of their expectancy or prospective
shares they should receive nothing and their
shares should bo divided proportionately
among the others. The heirs contested the
will on the grounds that Mrs , Ballard was
Infirm and feeble both In body and in mind
and without sufficient mental capacity to
make a valid will. They also alleged that
undue Influence had been brought to bear
upon her at the time she made the will.
The litigation promised to be lengthy nnd
expensive and In order to avoid having their
respective shares eaten up by the expenses
attending the suit the heirs agreed among
themselves to withdraw their objections to
the will and permit a distribution of the
estate. The agreement filed yesterday pro
vides that the court shall Issue an order
os soon as the executor Died his bond In tbo
sum of $10,000 for a distribution of $28,000
among seventeen of the heirs.
The value of the estate ready for distribu
tion amounts to $36,000 , but It Is stipulated
that about $8,000 bo heM for the shares of
two of the heirs whoso rights are disputed
nnd are to bo settled by the court and to pay
for the administration of the estate.
It was also agreed that the court appoint
a special administrator to represent the es
tate In the proceedings against the Woman's
Christian association , as N. M. Pusey , the
executor , acted as Mrs. Bollard's attorney
nnd drew up the deed whereby Mrs. Ballard
bequeathed to the association the property
now In controversy. This disposes of the
suit brought by the toelrs opposing the ap
pointment of Mr. Pusey as special admin
istrator.
In addition to a cash bequest of $10,000
Mrs. Ballard conveyed to W. H. M. Pusoy In
trust for the association om December 28 ,
1897 , three lots on First avcnuo Just west of
the Grand hotel , two lots In Beers' addition
nnd ono In Everett's addition. The property
on First avenue Is Improved and contains
twp residences , ono of which was Mrs. Bal-
lard's home. The property thus conveyed IB
valued at about $20,000. The heirs have
brought suit to have the trust deed set aside ,
aUeglng that It was secured through undue
influence. v

The Pedalers' Wheel club enjoyed a plc-
nlo trip , luncheon and fishing 'party ' at
Hanthorno lake Tuesday. The trip was
made In a four-horse carryall. > Mlss Lutz
won the honors of the day by catching
the biggest string of fish , "while Mr. Henry
Mann captured the prize for the biggest
flsh story. Messrs. Robert Peregoy , Fred
Searle , Clark Hayes , Charles Blnlno , Painter
Knox , Harry Mann , Harry Hattenhauor ,
Osro Blanchard , D. E. Stuart and Ray Blxby
were the guests of the club.
Miss Grace Beebo entertained charmingly
Tuesday evening In honor of Miss Helen
Baldwin. The guests -were given -che-wlng
gum and requested to mould It into minia
ture donkeys. The result was most amusing
nnd decidedly Interesting , It was unani
mously decided that the donkey made by
Miss Plnney was the most artistic. After
this an Impromptu muslcalo was held. The
rooms were gay In patriotic decorations and
tbo Idea was prettily carried out In the
elaborate refreshments served. The guests
numbered about fourteen.
The Hamilton Whist club was entertained
at the home of Miss Key Thursday after
noon by Mrs , Bender , Miss Farnsworth and
Miss Key. The prizes for the month wore
distributed , 'Mrs. Charles Casady winning
the first prize and Mrs , Bowles the second.
There will bo one more meeting of this
club , 'Mesdames ' ROEH , Shugart and Hess be
ing tbo 'hostesses. ' The date lias not yet
been decided.
Mrs. Lovert entertained at dinner on
Memorial day t the Pacific hotel Mesdamea
Ilallsback and Johnson. Mr. Levort , think
ing the party Incomplete , Invited Messrs ,

four men Joined the women at dinner , much
to the latter's surprise.

Manawa was the scene of a pleasant little
picnic on Tuesday last. The party was com
posed of Misses Sade Farnsworth , Bennet

the picturesque Rlcn was not the least en
joyable feature of the affair. Supper was
nerved on tables spread on the lawn. The
attendance was large.

church gave a very enjoyable sociable Fri
day afternoon nt the church parlors. Ice
cream and cake nnd other dainty light
refreshments wore served during the after
noon.
