Sin.it : Department's DcclHlon Anciit IlarlL-toii StrlUiTM. WASHINGTON , Feb. 9. The State de partment , after mature consideration , lias de clined to recognize the claim ot the Austro- Ilungarlan government for Indemnity on ac count of the Hungarian strikers killed by Sheriff Martin's posse at Hazelton , I'a , , on September 10 , 1897. The claim has been pending for many months upon the basis of a report flled wltb the Stnto department by Robert D. Coxe , the representative of the Austro-Hungarlan government. The department action Is based upon a special opinion prepared by Solicitor W , L. Penflcld , covering the entire field ot national responsibility in cases of mob violence or rioting , which probably will form the basis of future resolutions In that lino. In his opinion Solicitor Penfleld concludes with the following statement : The responsibility of governments toward foreigners Is not more extensive ) than that tit itho foreign sovereign toward his own sub jects. The rights of hoBpltnlly do not prevent - vent the entire cxcrciso of the rjght which belongs to sovereignty to employ the legal means to provldo for the preservation of the state , nor are foreigners entitled -to a priv ileged position , nw are .they exempt from the consequence of criminal conduct , threatened or committed ; nor nro they to bo indemnified for damagea resulting from such conduct nnd from tlio imperious ne cessity of watching over 'the ' pafoty of the public weal , This government cannot tolerate a etalo cf anarchy , cither threatened ° f Inaugurated , In .communities comnowd cither of Us own citizens or of aliens who may engage In In dustrial or other pursuits within Its ter ritory. If they obey the precepts of the la\v It will protect Ihem ; It they defy < lie law nnd the constituted authorities , then , In common with nil others who partlclparo with them in such acts of lawlessness nnd violence , they must bo downed to accept the consequence * of the conflict which they | r- vlto. * The strikers were disturbers of the public peace and violators of the law. They were rapidly drifting Into a slateof petty war. H wns the duty of the sheriff to tnko measures to prevent as well as .to . repress civil tumul'la ' and disorders. On previous oc. caeions ho had commanded 'them ' 'to disperse nn.l they obeyed , They were perfectly famlMnr with his ofilclnl position and the nature of the authority ho exercised , It they had obeyed his lawful command no blood would liavo been shed and In their lawless and aggressive conduct , challenging the embodied force of the state , they placed Oicm&clres beyond the protecting pale ot the law. To reward Ihe wounded living and the heirs of thoFC plain under such circum stances would bo offering a premium to law lessness nnd inviting renewed outbreaks and riots. This government Is , therefore , unable to admit the justice of > the claim. Y 'llo v I'Vvi'r I'll ( li * ill * ll ' t'r. OUANAJAY , Province of Plnar Del Rio. Cuba , Keb , > . Something- like fifteen or sixteen cars of cornfed steers Included all the offerings of fat cattle In. the yards. Local packers were In need of cattle and in addition advices from other points were favorable , so that the market become active and steady to u little stronger. The market on fat cattle Is now HXSjlSc higher than the low time the first of the week , about one-half of the break of last Aveek having been made up. Today some good , well finished cattle brought J3.40 , showing that desirable kinds will sell , and nt good prices. Desirable fat cows and heifers were fairly active at strong prices , and the offer ings for the most part changed hands early. It Is safe to say that the market on the best kinds of she stuff Is now back just about where It was the best time the early part of last week. Canner and common cow stuff were rather weak and slow this morning , and buyers did not appear very anxious for that kind. There is not very much to be added to what was stild yesterday and the day be fore as to the condition of the stacker and feeder market. As will be readily under stood by all who are familiar with the trade , the extremely cold weather has hod the natural result of keeping country buy ers at home. Supplies in hands of specu lators have moved slowly , and incense , < - < iucnce they have not taken hold very freely. The market has , therefore , de- dined for the want of buying support. Today a few feeders changed hands , but the i general complaint among holders was that | it was hard work even to get any one out to look at their cattle. It Is needless to say under such circumstances that the mar ket was very dull nnd weak on stock cattle and unsatisfactory all around. Representa tive sales : J5E7-3P STEERS. No. Av. Pr. No. Av. I'r.
