According to the decision rendered by Judge Macy In the district court yesterday afternoon , who took the case away from the Jury , Frank A. Dlxby , chief of police ot Council Bluffs , Is Indebted to the Sterling Manufacturing company In the sura of $1- 510 , money which he appropriated to his own use whllo In the employ of the company as its manager at this point. Judge Macy's decision was also adverse to Blxby's coun ter claim of $2,000 for alleged breach of contract on the part of the Sterling com pany In dismissing him from Its employ , the court holding that the circumstances fully warranted the company In dispensing with Mr. Blxby'e services when It did. At the close of the evidence yesterday the attorneys for the plaintiff moved the court to direct a verdict for the plaintiff for the full amount of Its claim , namely , $1,540 , and against the defendant on his counter claim for damages. After the motion had been argued pro and con Judge Macy promptly handed down his decision , holdIng - Ing that the evidence showed without any contradiction that the plalntlft had In structed Mr. Blxby , Its manager at the tlmo lu this city , to keep Its money In the bank I In the name of the Sterling Manufacturing company , but that ho had disregarded these | Instructions and had kept the money prop- i erly belonging to the company In his own I name and Intermingled It with his own t money. This was undoubtedly a breach of his duty as an employe of the plaintiff company and fully warranted the company In discharging him. The court found that as to the $600 which Blxby claimed ho had taken out of the funds for the company In his hands for his own use .by Its alleged | permission , the evidence was plain and un- contradletcd that he did not have such permission , but that on the contrary ho had received letters from the president of the company , expressly stating that he had not permission to use the company's money. This , Judge Macy held , was also a violation of the confidence reposed In Blxby by his employers and warranted the company In discharging him from Its employment. Thus the evidence showing that the plaintiff com pany was Justified In discharging him , the defendant Blxby had no grounds for a counterclaim ter-claim for damages for 'breach of con tract. The case of the Scottish Union and Na tional Insurance company against E. H. Odell will bo the first case called for trial In the district court Monday morning. The foreign will of Lcroy Tuttle of Wash ington , D. C. , was admitted to probate yes terday In the dlctrlct court. In the Injunction case of the Fort Dodge & Omaha Railway company against the Chicago cage & Northwestern Railway company and John S. ( Special Telegram. ) Sioux City's carnival week closed In a blaze of glory , but not until tired men nnd women were forced from sherc exhaustion to go home. Tonight was n night in which ovcryono turned loose to parade up and down the streets , throw confetti nnd other wise Indulged In Innocent fun at the expense - penso of others. It was traveling men's day and largo delegations came from neigh boring cities. The local traveling men were delighted beyond measure with the splendid delegation sent from Omaha. Over 100 men came In on a special train nnd It waa ac companied ty the fine McCook ( Neb. ) mili tary band. The visitors wcro met at the union depot by a largo number of Sioux City knights of the grip and marching to the music of two bands the visitors were taken to the traveling men's headquarters. Hero refreshments were served and a warm lunch put all In a good humor. The Omaha boys boosted for their exposition and It was In deed a merry love feast. In the parade Omaha was repeatedly cheered by the waitIng - Ing thousands. ( Special Telegram. ) The supreme court filed with Clerk Jones six opinions today , one of them discussing building and loan associations. From the opinion the fact Is presented that the leg islature has granted powers to building and loan companies not possessed by Indi viduals and by that act moro than S per cent , can bo charged for the uie of ironey with no liability of prosecution and con- vlctioi for usurv. The decisions' were : Thomaa Manatt , et al. , proponents , ap pellants , against D. F. Scott , et al. , contest ants , from Poweshlek district , affirmed. The Hawkeye State Savings and Loan as soclatlon against O. P. Johnson , et al. , ap pellants , from Marlon district , affirmed. Ella M. Smith against the St. Paul Farm ers' and Merchants' Insurance company , ap pellants , from Lyon district , reversed. Charles Klnkead against MoCormlck Har vesting Machine company , appellant , from Linn district , reversed. Jane Glllett against Jennia 0. McFarland and C. M. Dr. James Campbell , one of the oldest settlers of Polk county and DCS Molnes , died at 1 o'clock this morning at the I. X. L. hotel. Campbell was 111 for several months and his life hung In the balance for the last two weeks. Lung trouble was the primary cause. Ho came to Towa and settled In Van Buren county on first com ing west , and came to Des Molnes In 1846. Ho had lived In the state flfty-ono years. William Plckett died at Mercy hospital. Plckett was Injured 'by ' a street car two weeks ago , the wheels passing over ono leg and the Injury necessitating the am putation of ono foot. Ho was married. At a meeting of the executive commit tee of the State Teachers' association , held hero today , the full program for the annual meeting to bo held In this city on De cember 27 and 29 was arranged. It was an- i nounced that Dr. Emll Hlrsch , the famous I Chicago rabbi , Hon. S th Ixw ot New York [ ! City , Dr. M. V. ( ) The second annual plowing match was In every respect successful. The contest was witnessed by I perhaps 3,000 people. The most noticeable L feature of the match was the marked Im provement In the style of workmanship over the first match , held about a year ago. ( Special Tele gram. ) At the session of the Northeastern Iowa Conference of the Methodist church nt Marlon today Waterloo was chosen as the place for holding the next meeting. About fifty applicants for the ministry were examined today and Bishop Vincent made the address. Ho said It was the largest class and the finest conference he has over attended.
