May 20.-Speclal ( Telegram. ) Other startling facts were pre sented In such an array before Judge Weaver today In the action against County Attorney George C. Olmstead for trying to keep $3,940 that was placed In his hands by George Barber that the money was taken from the county attorney and placed In trust by the court. It developed that at the time ol the trouble between Barber and his wife , ho made a confidential friend of Olmstcad , and as such told him ho had the $3,940 and wanted him to keep It for him until after the trouble. Olmstcad took It , and as he was Barber's attorney , ho had his client swear on the witness stand that while in Chicago he had lost the money In a street car. While ho testified to this perjury , Olm- stead had the certificate of deposit In hit pocket and was trying Barber's side of the divorce case for him. On the llth of May , Olmstcad had had : he money for a year and Barber came from Chicago to collect It. It was shown thai Olmstcad refused payment , and finally when the man was almost discouraged , he con sulted another attorney , a friend of Olm- stead's , and together they went to the office and received $290 , for which Barber gavf a receipt In full for his $3,940. When he received this money he was so frightened by the threat of being arrested and senl to the penitentiary for perjury that he lefl town at once. It did not strike him ther that under this charge County Attornej Ol instead would bo equally guilty with him He wrote Hon. J. L. Kamrar , stating thai rather than be beaten out of his money Ir such a way ho would prosecute , If Mr. Kam rar would take the case , if ho were sent tc the penitentiary for life for perjury. Yes terday on the stand the county attornej said ho had paid Barber his money In full Today , on cross-examination , he admlttec tlmt he still had the certificate of deposit Disbarment and criminal proceedings an likely to bo commenced against Mr. Olm- stead.
